Is winning guaranteed if I file a civil case for bounced cheque?
Sir,
I have filed a police complaint against a bounced cheque.
After one year, the guy who took money from me said he closed the case by paying the fine. I want to get my money back from him. I was thinking of filing a civil case.
Since I will be paying a good amount of fees for court and legal advice, is it assured that I will get my money back?
Dear Questioner,
As you already know, the only way you can claim your money back is by filing a civil case against the person who owes you money based on the cheque that bounced.
I find it rather late to wait more than a year to claim such funds. However, we can look at the file and tell you our opinion.
In general, you might have an assurance to win a claim against your counterparty but no one can give you any assurance to find money in his pockets! Or find him if he flew out of the UAE!
You can only do your best to chase him and his assets, bank accounts and other resources in the UAE, but no one can assure you results.
And - my personal opinion - if you find a lawyer who assures you results don't trust him.
