Filing a bounced cheque case for debt recovery

Hello Sir

My query is I have a cheque of AED 154000 and the contract made between us for this cheque is also available.

Now the person who gave me the cheque is not paying and asking for time. Should I get his cheque bounced?

And if I file a civil case, how much % I have chances to get this money? He has 2 more companies which are doing quite well.

Suppose he comes out on bail, is my cheque valid? I heard if he completes a jail term, then he is not liable to pay this cheque.

Thank you so much for contacting online.

After going through the details, you have entered into a contract with someone and lent money to him and he issued a cheque to you, and now he is not ready to repay you.

First of all, you have to present the cheque for collection. If it bounced, you can move a criminal case against him initially.

And even if he got rid of that case by paying a fine, his liability will not be over. You can file civil case also against him for recovery of the above amount.

If he has got two other companies which work well, it is easy to take steps against him for recovery.

So please go ahead with presenting the cheque, and if it is not cleared through, you can go for the options above.
