Dear Mr Malalla, I would like to get your opinion on an incident that I am going through at the moment with my previous landlord. After staying in the same apartment for 4 yrs as a tenant, on 8/2/21, only a week before the renewal term (15/2/21) and after having a written agreement on a mutually agreed condition as well as sending us the contract, our landlord declared to us that he changed his mind and would apply the old contractual terms. After having back and forth emails with our landlord's agency, on 23/2/21 we received the final email about his decision from the agency. As I did not want to stay in his place, we moved out on 6/3/21. On 14/3/21, we received a quotation from the agency in regards to maintenance, which we mutually accepted on 15/03/21. 2 days ago, when I was waiting for my security deposit, I received a final calculation from the agency charging me the period between 15/2 to 5/3 as overstay. We reminded him many times of the rules and regulations but he does not care.

ما الإجراء القانوني مع موظف تقدَّم باستقالته عن طريق البريد الإلكتروني ووضع جميع الموظفين وأصحاب العمل بالبريد الإلكتروني، وبعد يومين، تقدم بشكوى عمالية ضد المنشأة يطالب براتب شهر عن عمله من المنزل أثناء إجازته السنوية المدفوعة بالكامل بالفعل؟ لم يطلب منه مديره المباشر أو أصحاب العمل أن يعمل أثناء إجازته لا شفهيًا ولا كتابيًا مع العلم أن عقده غير مُحدد المدة ويعمل منذ ٣ سنوات ونصف. هل يجوز أن يُكمل شهر الإنذار بعد تقدمه بشكوى عمالية؟

Dear Sir I have cancelled the purchase of a property in Dubai and the developer has agreed with my decision. The developer committed in writing to refund the agreed settlement amount “within 90 days “. I have kept consistent follow-up records and everything in writing between the developer and me. However, 1 week before the 90 days expiry period (due to my constant and persistent follow up in writing) the developer has stated it will take another 90 days for them to refund me the monies, sighting COVID-19 as “ the “ reason. Am I able to enforce the email agreement between the developer and me to recover the agreed settlement within the 90 days and latest at the 90-day deadline? هل يجوز لمحاكم الإمارات الحكم بنفقة أطفال انتهت إقامتهم في الدولة قبل تاريخ رفع دعوى النفقات وبناء على إقامتهم مع الأم خارج الدولة؟ ألا يعتبر ذلك تعديًا على الاختصاص المكاني للمحكمة والأصل رفض الدعوى وإرجاعها إلى المحاكم المختصة في دولة إقامة الأطفال؟ شكرًا مسبقًا للرد!

أعمل بعقد محدد المدة ينتهي بعد ستة أشهر مع شركة مقرها الرئيسى دبي ولكنى أعمل بفرع أبوظبي ولذا فكل المرسلات عن طريق الايميلات من خلال الأوت لوك. فهل هذه الايميلات يعتد بها أمام المحاكم من عدمه؟ وماهو شروطها؟ وهل يحق لى الشكوى فى أبوظبي علماً بأن إقامتي دبي؟ فضلاً عن أنه لدي إيميلات تبين نسب العمولة في حالة تحقيق المستهدف كل عام ولكن الشركة تتهرب من تقديم كشف بالمحقق عن العام الماضي 2019 حتى تاريخه وترفض إعطائي بيان به حتى تتنصل من دفع العمولة ووصل الأمر أنني حققت للشركة عقد بمبلغ كبير يفوق الهدف (التارجت) بأضعاف وتحاول الشركة التنصل منه وتتلاعب حتى لا تقوم مرة أخرى بدفع عمولتي لهذا العام 2020. ولهذا السبب فوجئت بالشركة اليوم بتوجيهها إنذار لي بسبب سوء السلوك ولم تبين سبب ذلك أو تجري أي تحقيق وبهذه الصيغة فقط فكيف يتسنى لي أن أحمي نفسي من ضياع حقوقي؟ علماً بأن طبيعة مجال الشركة تستلزم أن العقد الذى وقعته يتم توريده فى شهر أكتوبر المقبل. هذا فضلاً عن سوء المعاملة لإجباري على الاستقالة، فهم يعلمون أنني لن أجدد العقد معهم ولذا يحاولون مضايقتي حتى أستقيل أو يقومون بإقالتي وحرماني من حقوقي. أرجو النصيحة وشكراً مقدماً

كيف يمكن لشركة ذات مسؤولية محدودة أن تعلن إفلاسها؟

Hi I'm a tenant of an apartment and a new owner has purchased the apartment. I would like to know: 1. Should I revise the Ejari by canceling the previous one and applying for a new one? 2. My current rent is 35% less than the current market value. Can the new owner change the rent as per the market value, or he still has to follow the RERA Index calculator for a new contract?

I'm staying in JLT in a house with a rent of AED 140,000 per year. The lease starts on 1st Sep '23 and expires on 31st Aug '24. The landlord sent me a legal notice from the Dubai Courts in mid-Sep '23, giving me 1-year notice to vacate the house as he plans to sell the house. The notice was received by me through email from the court. He claims the email notice sent by the court is not valid till I receive it by courier via Aramex for my physical signature. Can you please confirm if this is true? The landlord is now ready to let me stay in this house for two more years. He has proposed that we maintain the existing lease agreement and Ejari. However, I should pay him AED 14,000 in cash (10% increment). We will sign a separate paper document wherein we will agree that I will further rent increase of 10% (10% on (140,000+14,000)) on 1st Sep'24 when my current lease expires. Should I insist on making a fresh written contract with the higher rent (140,000+14,000=154,000)?

Hello. I have been with my employer for 15 months, and my employment contract is for two years. Is it possible to terminate the contract before the end of the two-year term?

Hi I have signed the MOU Form F since July 2023 and we prepared all the papers and the loan from my end on 23/8/2023. When I went to DLD for the transfer, the seller had registration issues and asked for some papers to be provided as the property is under the company not an individual. Since that time, we have kept renewing the MOU every month in the hope of finalizing but I am not seeing any progress. So I am asking about legal action as I already got a bank mortgage and started paying as well but not seeing any progress from the seller. So I need to ask the following: 1. If my MOU expired on 20.11.2023, can I file a complaint on 20 or after a couple of days like 23? 2. What will happen in terms of 10%? Will it be returned and what about the fees paid to the bank like mortgage fees, evaluation, and cancellation of loan? Will the EMI payment be compensated by the seller? 3. What is your advice? Thanks
