س: هل تتعامل مع استرداد الأموال من شركات فوركس الوهمية؟

Q: Can a person be prosecuted in the UAE for doing something which is legal in a country where he/she did it, but it is illegal in UAE?

Q: I am an individual working in Dubai and photography is my hobby/passion. I did a time-lapse project for a person here in Dubai. He owns a free zone company and also works with different media agencies in Dubai. My 3 movie clips from that time-lapse project are being used in a documentary running in 1 airline (I watched while travelling through that airline). I never had any signed agreement. It was all mutual understanding and all conversations happened through emails. Now, after knowing my time-lapse clips already been used in airlines without paying me anything, I have been following up with this person for the last 1 year. He's not paying me my money. I even tried to approach the airline and the response I got from them is "Airline already paid the agency hired to get that job". What does the UAE law say in this case and if as an individual I can sue the airline or how can I get my money? Any help or advice will be very much appreciated. Thanks.

س: السلام عليكم، لدينا مذكرة تفاهم موقعة بين شركتنا في الإمارات (طرف منتج) وشركة في اليمن (طرف ممول) لتنفيذ عمل تجاري وكافة البنود المذكورة تنفيذية وتترتب عليها غرامات في حال عدم التزام أحد الأطراف بمسؤولياته. الشركة التي في اليمن لم تلتزم عمدًا بالتمويل وتماطل لأشهر عديدة رغم توفر السيولة المادية الكبيرة عندهم حتى أثر ذلك سلبًا على الشركة في الإمارات وترتبت عليها غرامات بسبب عدم تجديد الرخصة، وستلغي الإقامات عليها لعدم توفر السيولة المادية. السؤال: كيف لنا أن نقاضي الشركة اليمنية في أسرع وقت ونجبرها على دفع التعويض لنا سواء استمرت الشراكة أم انسحبت منها؟ علمًا بأننا أبلغناهم رسميًا بدفع غرامة معينة بسبب تقصيرهم مما ألحق بنا أضرارًا كثيرة مادية ومعنوية. وهل لنا أن نلجأ للملحق التجاري في القنصلية اليمنية في دبي؟ أرجو المساعدة! مع الشكر،

This Law promulgates the Federal Penal Code (Criminal Law) of the United Arab Emirates. Crimes and chastisement punishments shall be determined in accordance with the provisions of this Law and other penal codes.

The provisions of this law On Evidence in Civil and Commercial Transactions (Law of Evidence) govern evidence in civil and commercial disputes in the UAE.
