Requirements for exemption from court fees in labour cases

Q: Are the labour court fees mandatory? Our lawyer filed the case for us in Fujairah and now the court wants us to pay AED 5000. We asked our lawyer to waive the court fees for the case but after 2 weeks, we followed up and the secretary of the lawyer said to us that the court cannot waive the fees. Our co-workers did not pay any fees in Abu Dhabi and Dubai courts where they filed their cases and now most of them received their judgment. Because of this, we are having second thoughts of our lawyer. There has been no progress since we provided our documents and SPA 6 weeks ago. Are court fees really mandatory to be paid? The secretary of the lawyer said to us the case will not push through if we will not pay. The thing is we did not receive 4.5 months of salary and the court fees are much of a burden to add. Thank you.

Paying the fees of expert appointment in the UAE courts

Q: Hi, I have a labour case in Sharjah Court against my employer. The judge said that my case has been transferred to the "expert service" in the last hearing and I have to pay AED 4000 for that. The next hearing date has been appointed on 25.11.18 and 25.12.18. I am kindly asking you to clarify: 1) What does it mean "labour case transferred to the expert service"? 2) Should I pay AED 4000 for "expert service" if it's optional? As the secretary of the judge explained to me that I can ask the judge not to pay (I do not have money) or partial payment. 3) Can I refund the total amount of "expert service" fee, if I win the case? 4) Will the payment of "expert service" fee affect the court decision or end date?

Q: Dear Sir/Madam, I have a real estate claim case in court, with several sessions held. The defendant only appeared for one session. On judgment day, the judge requested an expert appointment, which costs 15,000 AED. If it’s not paid, will the judge dismiss the case or will the judgment be unfavorable to me? I received a very short notice period to pay the fee.

Can I start a dispute against a bank for overcharging without paying the full court fee upfront?

Q: Dear Sir/Madam, I am seeking legal advice for my ongoing cheque execution case with a bank. I wish to open a dispute case against the bank for claiming more than I owe. However, to open a substantial dispute case, the court fees are around 20,000, which I cannot afford to pay in one shot. Is there a way to request the court to start the case with my passport as a guarantee, with a minimum amount, or to pay the fees in installments?

How to file a case against my former company for unpaid salary I was not on their visa?

Dear Legal Advice Middle East, I hope you are well. I am seeking legal advice regarding an unpaid salary issue with my former employer, [-----]2 LLC. I was employed with them from December 4, 2024, to January 7, 2025, on a monthly salary of 5,000 AED. However, I only received a partial payment of 2,473 AED on February 24, 2025. The remaining 2,527 AED is still unpaid. I submitted a complaint to MOHRE on March 2, 2025, but I am unable to proceed further through their official channels. This is because I was working under the visa of my previous employer, [---] LLC, and not under [----]’s sponsorship. As a result, I do not meet the criteria to file a labor complaint via the MOHRE app or hotline. Given this situation, I would appreciate your guidance on how I can legally pursue the recovery of my remaining salary, considering the complications related to my visa status during the employment.
