Can I start a dispute against a bank for overcharging without paying the full court fee upfront?

Dear Sir/Madam,

I am seeking legal advice for my ongoing cheque execution case with a bank. I wish to open a dispute case against the bank for claiming more than I owe.

However, to open a substantial dispute case, the court fees are around 20,000, which I cannot afford to pay in one shot.

Is there a way to request the court to start the case with my passport as a guarantee, with a minimum amount, or to pay the fees in installments?

Dear questioner,

There will be a court fee, and it cannot be postponed or reduced. It is 5% in Abu Dhabi and 6% in Dubai of the total claim amount, and it is a mandatory payment.

It will be better to hire a lawyer to quash extra amounts of the case through proving, or we can engage in negotiation with the bank for a better settlement plan.

Dear questioner,

The chances are slim to reduce the court fee or make the court fee payment in parts. We can try by requesting; however, it is at the court's discretion to accept.

But if the case is filed, there are high chances to quash the extra amounts, interest, and penalty charges.

Dear Questioner,

Thanks for your inquiry!

Regarding the above, we would like to inform you that, according to UAE law, the court fees for opening a dispute case are fixed and cannot be waived or reduced.

However, you can request the court to allow you to pay the fees in installments or provide a guarantee, such as your passport, for the payment of the fees.

This request will be at the discretion of the court and they may or may not grant it. It is recommended that you consult with us as a lawyer who can assist you in making this request and guide you through the legal process.

Kindly feel free to contact us at [-----] for further guidance.

Greetings,

You can apply to defer payment of fees or request an exemption from paying the fees. Installment payments or passport withholding are not acceptable.

In situations where you are facing financial constraints to pay court fees upfront, you can explore options such as requesting the court to allow installment payments for the fees or offering an alternative form of security, like your passport, as a guarantee.

It's essential to contact a legal professional who can guide you through the process and help you navigate the legal requirements and potential options available to you in your specific case.

They can assist you in presenting your request to the court effectively and exploring the best possible solutions for your situation.
