Q: I had rhinoplasty surgery. Prior to the surgery, the Doctor had agreed to perform an open rhinoplasty to refine the tip of my nose and adjust the bridge of my nose. After receiving the payment from me for the surgery, the Doctor then refused to carry out the full procedure that he had agreed on and that I had paid for. I would have never paid for the surgery had I known that he was not going to carry out what had initially been agreed upon. I have also been left with a large boney lump at one side of my face, between my cheek, nose and going up to below my tear duct. This was not there before surgery. When I received my discharge papers from the hospital, the Doctor had written down my diagnosis as "large nose", with no accurate diagnosis/description of the actual surgery that was performed. I now have to get another surgeon to fix the bone sticking out of my face. I would like to take legal action against the surgeon that did this to me. I am looking for some advice on this.

Q: Hi. I won a DHA ruling of malpractice against a Dubai-based dental clinic and need to go to court to recover the money I paid out. I’m also hoping for some compensation for the year of pain and inconvenience I went through as a result. I'm told that I have to pay 6% of my claim up front. How much should I claim? I spent AED 30,000 on the original dentist and AED 80,000 correcting the problem. I gave a statement as part of the malpractice case. Q: I had a keratin treatment on December 31 and after a day I complained as they have damaged my hair. They advised me to blow dry my hair every after the shower. I tried it for a few days until I got tired and it isn't supposed to be this way, so I went back to the salon and talked to the owner. She claimed that it's their mistake and advised me to give my hair a rest for 2 weeks so they can do the same treatment again. I agreed. However, I am hesitant that my hair might be more damaged as it is already brittle and crumbled. It's totally destroyed. I have another week to do the same procedure again. Can I demand to take my money back and not do the same treatment again?

Q: I got 2nd-degree burns in my buttocks and 1st degree burns in 6 places thru a slimming beauty center where I was advised to do a Detox machine. They wrapped me full and put me in high heat. I screamed for help but no one came until it was 20 minutes. I got burnt which I didn't realize but told it's too hot, switch off treatment, I don't want. I want to sue the company for compensation due to their negligence. I have had a sleepless night. On my birthday date, I was in the hospital for 4 hours. I had to go to Dr every day for the bandage. I am traumatized. I went to the police station. I went to DED but in the end, they said to go to Court. I am confused. I have a medical report plus all my burns photos. It happened on April 3rd. Q: Hello, Good Day, My wife went through nose surgery a few years ago in a reputed hospital in Dubai. We were not satisfied with the surgery and we filed a complaint with Dubai Health Authority. After initial investigations, they found there is a medical error and issued a report to us. However, the doctor went in appeal to The Higher Committee For Medical Liability in MOH. And now, this committee came up with a final decision stating "Doctor did not comply with the accepted medical procedure and to this medical error, the patient is suffering and have to go for another surgery" As we have both final reports one from DHA and the other from MOH, we are ready to file a lawsuit. But prior to that, we need to know the estimated timeframe and cost associated with the lawsuit. Thank you F. S.

Q: Hi, Today I received the final medical report made by the doctors committee at DHA. The report says the doctor and the hospital made a 100% medical error (I took medicine that the doctor prescribed and they were aware I was allergic). This Law promulgates the Federal Penal Code (Criminal Law) of the United Arab Emirates. Crimes and chastisement punishments shall be determined in accordance with the provisions of this Law and other penal codes.
