Q: I joined a company in Abu Dhabi three months before. Due to some quota issues, they gave me a messenger visa on my passport.
Now, they don't have a project and want me to search for another job or they will cancel my visa.
My contract is limited-term and my visa is a messenger.
Question is if they cancel my visa, will there be a labour ban?

Q: Dear Madam,
I have an unlimited contract with the employer and I have not completed the 6-month probation period. The company gave me a termination letter without any warning letter before.
1. If I get a job in some other company, will I get a labour ban or not?
Some people told me even if you have an unlimited contract, but your company terminated you under probation period. I must have completed 1 year to avoid the ban. Please advise me, what do I do?
2. The company gave me termination letter one day before my completion of the 6-month probation period.
My question is that I joined the company on 27 August 2017 and the company gave me the termination letter on 26 February 2018, but if I count the days then it is 184 days, while 6 month means 180 days. Please advise?
3. If 184 days are considered 6 months what are my rights? Can I demand the company to pay my settlement, air tickets and half year leave salary... etc?
The HR told me that under probation, the company do not pay me any benefits like back home tickets, gratuity...etc.

What is the start of the contract date that MOHRE take into consideration?

Q: Good morning,
The company made me redundant one day before completing the 6 months probation period.
As per the contract of MOHRE, the start date is 18 Oct but they asked me to sign a letter late that the start date changed to the 27th of Oct and I had to sign the letter.
The letter is not even signed by some IT guy in the office. I feel they knew what they are doing hence the new letter to change the new start date.
Can I complain about that?
Is the letter recognized by MoHRE or the date on the contract is the one?

An employer insists to serve 53 days after termination. What should the employee do?

Q: Dear sir/madam,
I am currently employed in Tecom Area, Dubai. My employer tendered me a notice of termination for my employment contract within the 6 months probation period.
The employer told me I need to work 53 days more after the termination notice is served. Do I have the right to insist to have my visa canceled if I find a new job after 14 days from my termination notice?
How do I resolve my issue if my employer will not cancel my visa and insisted I should finish the 53 days period he provided?

How to calculate the notice period upon termination during the probation period?

Q: Dear Sir/Madam,
My company is registered in DMCC Dubai.
On May 2, 2023, my HR emailed me in the evening to relieve me of my duties on May 4, 2023, which is against the UAE labor law because a minimum of 14 days' notice period is mandatory from either party during probation.
On May 4, 2023, I was forcibly relieved of my job. The next day, I emailed HR to address the legal provisions.
On May 8, 2023, I received an email from HR to report to the firm on May 9, 2023, and serve the remaining notice period of 11 days.
Do the period from May 5 to May 8, 2023, count towards the notice period as per the labor law of the UAE?
I need your expert advice.

Can I take legal action and remove absconding for termination during probation?

Q: I came to the UAE on a visit visa on September 14, 2023. Then on October 11, I went for an interview. On October 12, the company offered me the job and signed the offer letter.
I will start working on November 1. After that, they asked for my visa copy on November 7 and I sent it. Then on November 9, they asked for my passport-size photos for my job visa.
Exactly on November 14th, the day my visit visa expired, the HR manager fired me from the job because my performance was not good enough. It's been exactly one month since I signed the offer letter.
I'm waiting for the job visa and I trusted them but they fired me before my visa expired. They gave me part of my salary for the 12 days I worked. Because of their mistake, I am absconding now.
I need to renew my visa. Can you help me to remove it?
I need to renew my visa soon. I am collecting fines. Help me.
Can I take legal action for the injustice done to me?
I have all the proofs. What should I do?
Please help me!

How is the probation period calculated exactly from the date of signing the contract?

Q: Regarding the probation period, when is the deadline for an employer to terminate me if the DOJ anniversary is Friday 2nd Feb?
Will the six-month period end at midnight on the 1st, therefore completing six months, or can the employer still terminate on the 2nd?
Appreciate any guidance provided.

I recently purchased a property in Springs which is rented till September. I need legal advice on the procedure to send an eviction notice to my tenant as I need to occupy the property for personal use.
As far as I read in the RERA legislation Page 108-110, Article (25) - Section - 2, if the landlord wants to occupy the property for personal use, 90 days notice is sufficient.
But the tenant insists to have a 12-month notice. What are my options and is it possible to send a legal notice to the tenant to vacate the premises at the end of the rent contract?

The property was supposed to be delivered in June 2018 and is still not delivered. If they actually deliver by June 2021, what are my rights to the compensation?
At the time of purchase, it was a 50-50 payment plan. I paid the 50% at the time of purchase and in September 2019 they came back to me with an offer of a discount of 16% in the final settlement amount.
I accepted and paid the remaining amount as well. Therefore as of September 2019, I have paid 100% of the property value.
With all the financial challenges the delay has brought me into, I want to know what compensation is my right as I am assuming they will not be offering anything or if they do they might offer some waiver in service charges (for 1 or 2 years).
And I am worried if they give this waiver of service charges to everyone, will the property be actually taken care of or no?

Hello,
I am originally from the UK and relocated to Dubai in 2004 when my company established a new office.
I originally joined the same company in 2001, based in the London office. Since then, I have grown with the organization and am in a middle management role.
Recently, the company announced they would downsize the Dubai office, and affected staff would be offered to relocate back to an office in their home country (India) or to the new office being established in Spain.
I have been advised that my present role will be made redundant in Dubai but have been offered a new role in Spain. The new role is seen as a promotion but there are little to no benefits and it's a major drop in salary (basic salary would drop by 40%).
There are no additional allowances. Currently, I receive basic salary + allowances.
I have been in the UAE since 2004 and my options appear to be limited to accept redundancy or a new role with a significant drop in salary. Would this be considered constructive dismissal?
