Employer's request to sign a clearance letter for unpaid dues upon termination

Q: I was a Project Manager for a company. After 9 years of my service, the company has terminated my services for the last 45 days (Because work is less & they want to downsize the staff strength).
I don't mind going back to my country, but they are expecting me to sign an Arabic letter stating that all my dues are paid, for the closure of my visa which is getting over on 07.10.2017.
Since the financial condition of the company is not good, they are not in a position to settle my gratuity & other benefits. They are not giving any clear-cut date on which they will settle my dues.
My worry is that once I sign the Arabic letter & my visa is cancelled, I cannot continue in the UAE beyond 28 days after visa cancellation.
I don't want to go against the company to pursue legal step, but at the same time, I am worried about my dues that I may be denied once I sign the Arabic letter & I am out of the UAE.
Please advise what I have to do?

Q: Hi,
On the 29th of March 2017, my UAE (Abu Dhabi) visa has been cancelled by my employer and I never put my signature on papers to cancel the visa, due to my outstanding dues (AED 82000).
But they had put my signature to cancel my visa. Thereafter, they have transferred me to Qatar and said we will settle your outstanding dues soon, but still, they have not settled the said amount.
Now, I'm camping in Dubai with the help of a one-month visit visa to receive my outstanding dues. My employer is saying to go back to my hometown and they are promising that every month they will send AED 10000 to my account.
However, this statement is not acceptable to me. I need my whole outstanding dues in one payment.
Kindly advise me.

How to file a claim against my company for holding the EOSB after resignation?

Q: I resigned from my job on 1 July, and on 31 July I completed my notice period. Until now, I haven't received my EOSB.
The accounting teams already contacted me upon calculating my EOS and I have signed to them.
But regarding the payment transfer, they are informing me it is under process.
Please advise on how I should approach the email to the accounting team on the follow up.

س: السلام عليكم،
أعمل في فندق حكومي. لم أستلم رواتب أول ستة أشهر من العمل. تعرضت لضغوطات كثيرة من طرف المدير؛ مثل: العمل لساعات إضافية مجانًا، وتغيير موقع العمل كل يومين، وإعطائي عقوبة الجلوس في البيت بدون أي مبرر لمدة شهر مع العلم أنني الوحيد الذي يتعاملون معه بهذه الطريقة.
عندما تكلمت عن حقي مع المدير، أحضروا ورقة إنهاء الخدمة ويجبرونني على توقيعها يوميًا ويحاولون منعي من دخول الفندق، وكذلك إخافتي وتهديدي بإحضار دورية الشرطة في المرة الأولى ورجل مباحث الفنادق التابع لشرطة أبوظبي في المرة الثانية والذين هم أصدقاء المدير.
مع العلم أنه عند محاولتي فتح تطبيقات مثل تطبيق ICA أو MOHRE أو UAE Smart ID، أتفاجأ أن رقم هاتف الفندق أو مندوب الفندق هو المُسجّل في قاعدة البيانات الخاصة بي في الجوازات.
أطلب مساعدتكم لإرشادي. ماذا أفعل لأنني مقهور أقسم بالله؟

س: السلام عليكم ورحمة الله،
أعمل في فندق بأبو ظبي، وبسبب مشاكل صغيرة تلقيت من المدير ورقة الفصل من العمل. لم أوقع وفي اليوم التالي عندما كنت في الدوام، أحضر لي المدير بعض أفراده ممن يشتغلون في الشرطة لكي أخاف وأوقع على الورقة ولم أوقع لمدة ٣ أيام متتابعة يحضرون لي الشرطة ولا أوقع.
بعد ذلك طلب المدير من حراس الأمن منعي من دخول الفندق. لم أستلم رواتب ولا أي شيء منذ شهر ١٢، كنت أذهب إلى الشغل ويجبروني على الرجوع ويطردونني ويقولون لي سوف نلغي إقامتك حين يفتح الطيران إلى بلدك.
بعد ٣ أشهر أو أكثر من العذاب مرضت فيها، تفاجأت أنهم ألغوا بطاقة العمل من طرف الشركة ووقَّع المدير في مكاني ولم أستلم رواتبي.
مع العلم أنني كنت أذهب يوميا إلى الفندق وهم يطردونني وكنت أدخل أوقّع مقابل بعض الكاميرات. عندما عرفت أنهم ألغوا بطاقة العمل، ذهبت إلى المدير ولم أخبره أنني أعرف كل شيء. تحايلت عليه وإذا به يعطيني أوراق الإلغاء لكي أمضيها. جميع الأوراق مستندات إلغاء حقيقية وتحمل توقيعه بتاريخ هذا الشهر.
أخذت الملف ورحلت وهو معي. ماذا أفعل في هذه الحالة لآخذ حقي؟

I have issued a blank cheque for my EMI, and now the company is using my blank cheque and putting any amount to deposit it.
