Q: Hi, I have purchased a property in Dubai in 2014 and was promised for handover after 6 months, but didn't complete. In 2018, the property was ceased by the land dept but the project where we had our unit was 90% complete so it was not cancelled and now they gave it to a new developer to complete it and hand it over. We were told by the land dept now to contact the new developer for registration and handover. Now almost 2 months passed we have sent multiple emails to the new developer but no response from them. Not even acknowledged. What should we do in this situation? We have paid the full amount.

س: سلام عليكم، قام المطور بتقديم رسالة فسخ عقد بسبب تأخُّري عن دفع دفعة أخيرة فقط بقيمة ٧٥ ألف من أصل ٣٧٥ ألف. سبب تخلفي عن دفعها هو تأخُّره عن إكمال المشروع بما يقارب ٣ سنوات. أثناء تقديمه للرسالة، أبرمنا اتفاقية ودية بأن أدفع المبلغ على دفعات بسبب عدم قدرتي حينها. دفعت ٢٠ ألف وبعدها ٢٥ ألف في غضون ٣ أشهر وهي المدة التي كانت فيها الرسالة قيد التنفيذ من الجهة المرسلة. بالرغم من إرسالي كافة المستندات للجهة المرسلة إثباتًا للدفع، إلا أنه تم إكمال الإجراء وفسخ العقد. مع العلم أنه عند مراجعتي للجهة المسؤولة وإثبات أنني قمت بسداد ٤٤.٣٪؜ من أصل ٥٠٪؜ قبل إيصالي رسالة فسخ العقد، لم يقم المطور بإعطاء بيانات كاملة عن دفعاتي وبالتالي اتخذت الجهة قرار فسخ العقد مع علمها بعد ذلك بأنني سددت ٤٤،٣٪؜ ولكنها طالبت المطور بإرجاع الوحدة ولكنه باعها لمشترٍ آخر فور حصول على نسخة فسخ العقد. إلى الآن المطور لا يجيب ولم تتخذ الجهة أي إجراء ضده وفي الأخير أهدرت أموالي. سؤالي: هل لي مقتضى مما ذكرت بشكل قانوني؟ وبأي طريقة أستطيع رفع دعوى قضائية ضده للتعويض؟ ما تكلفتها؟ وهل قضيتي مضمونة باسترجاع المبالغ؟ إن كانت نعم، فكم تستغرق؟

Q: Hi, I would like to raise my concern regarding my off-plan purchase of a 1-BR unit in Dubai. The handover should be last quarter of 2022 as per SPA, but the construction is still under 50%. Next month Sept. 2022, I will be paying my final downpayment to complete the 20%. Our original plan was to mortgage the property after paying the DP of 20%, however, it would be perhaps impossible to mortgage given the current status of the building. By Oct. 2022, I need to pay 40% (227k AED) and the remaining 40% on handover in Dec. 2022. My question is, do I have the right to terminate the contract based on the current status of the project? They called me to negotiate in their office in AUH to discuss with top management our options and the new handover date is the 3rd-4th quarter of next year (2023). My current situation is not so favorable (financially). My only option is to either mortgage the property or cancel the contract. Your advice is highly appreciated. Thank you! Regards,

س: السلام عليكم، تأخّر المطور في تشغيل المشروع الفندقي. بعد مرور ٣ سنوات من استكمال البناء ولأنني أحد الملاك، فقد دفعت أكثر من ٩٠% من قيمة الوحدة وتم تسجيل الوحدة في دائرة الأراضي والأملاك. الآن بحسب الزيارة الميدانية فإن المشروع غير مؤهّل لأن يعمل حتى هذا العام ٢٠٢٣. هل يحق لي المطالبة باسترداد الأموال المدفوعة؟

Q: Dear Lawyers, I bought a property in Dubai, and the developer is 12 months late with the progress still 50% incomplete. Can I file a case and terminate the contract?

This Law establishes interim property register in which sale contracts, off-plan sales, and other off-plan legal dispositions of real property are registered prior to inclusion in the property register maintained by Dubai Land Department.

The provisions of this Law supersede articles (2) and (11) of Law No. (13) of 2008 Regulating the Interim Property Register in the Emirate of Dubai.

This Resolution approves the Implementing Bylaw of Law No. (13) of 2008 Regulating the Interim Property Register in the Emirate of Dubai.
