فترة الإشعار الإلزامية في حالة إنهاء الخدمة للزيادة عن حاجة العمل
لقد كنت أعمل بصفتي مدير مبيعات في شركة ذات مسؤولية محدودة لمدة 22 عامًا. وفي شهر مارس 2020، تم إنهاء خدمتي بسبب الزيادة عن حاجة العمل.
يرجى تقديم المساعدة فيما يتعلق بأسئلتي الثلاثة والشكوك التي لديّ.
1. يشير "عقد العمل غير محدد المدة" بتاريخ 13 أغسطس 2017 إلى أن فترة الإشعار المسبقة مدتها شهرين. ويشير العقد المجدد إلى أن فترة الإشعار مدتها شهر واحد، وهو الأمر الذي لم أتحقق منه أثناء توقيع وثائق التجديد. هل يحق للشركة تغيير هذه النقطة؟
2. ما هي حقوقي من فضلك؟
3. إذا كنت قد تعرضت للفصل أو الغش، هل لا يزال بإمكاني الحصول على مستحقاتي القانونية، إن وجدت؟

Pursuant to the query, your employer needs to serve you only 1 month notice period if you have signed the new contract stating that if either of the parties wants to terminate the contract, he has to serve the other party 1-month notice.
Also, you are entitled to get your gratuity, EOSB... etc.

You can initiate a complaint with the MoL for arbitrary dismissal wherein you can claim salary up to 3 months in lieu of arbitrary dismissal.

Whatever your current labour contract stated for the notice period will be applied in your termination.The contract can be changed any time with both parties' consent.
If the termination is arbitrary you can claim arbitrary dismissal compensation and in that situation, the court can grant you 3 months maximum salary as compensation and termination by your employer.
Then you are also entitled to a ticket to your home country, gratuity, and other remaining your dues.
For all the above, if you don't get from your employer, you should call 80060 (MOHRE Tawafouq) and file a complaint. And if nothing is settled in Tawafouq, then you should file a case in the labour court.
