Q: Hi,
My rental contract expires in December 2016, however, since I can't afford the rent I am giving my two months notice to vacate the place by September 2016 paying 2 months rent.
However, the landlord tells me that I can't stay in the place during my notice period and I still have to pay rent for 2 months.
Please advise.

Q: My tenancy contract specifies that "In the event of early termination, Tenant shall have to serve two-month written notice prior to the vacating date and to pay two months rent as a penalty to the landlord and the remaining balance to be refunded".
Based on that, please advise if during the two months notice I can stay in the property and paying those two months rent (which are effectively already paid) are the penalty or if after the two months notice an additional two months rent should be paid as a penalty?

Q: My tenancy contract was made until September 2018, but I'm losing my job now. Therefore, I have to terminate my contract with a one month notice.
But the landlord is asking for two extra months rent after my eviction period also.
Please advise me about this.

Penalty for the early termination of tenancy contract

Q: I have a tenant in JBR for many years who is paying rent in 2 payments.
The 2nd payment was due 1/3/18 but he delayed it and has now sent me the payment for only 4 months, as he wants to leave at end of June as per clause below.
The contract states:
6. If the tenant would like to terminate the tenancy agreement prior to the contract end date, three months written notice must be given by the tenant and the tenant will be required to pay the equivalent of one month's rent as compensation to the landlord with all remaining rent returned to the tenant.
7. If clause 6 is invoked, the tenant will be refunded his/her remaining rent (excluding the one-month penalty) and the security deposit pending a move out inspection report of the property.
My point is that he should have paid the full 6 months rent instalment on the 1st of March and he would have received a refund of only 1 month after moving out.
Do I have any grounds to take action against him?

Extending the tenancy contract for two months upon expiry

Q: My tenancy contract, drawn under the land department of Dubai, expires on 24th of November. I wish to extend it for 2 months.
The landlord says we can only renew for a year but is open to options as long as they are legal.
Is it true that I cannot make a new contract with my landlord for 2 months?
If I am forced to make a new contract for a year, can I have the 'premature termination penalty' clause removed?
(So I can give 2 months notice as soon as I enter into the contract and not have to pay a penalty).

Penalty for early termination of the lease contract

Q: I have a studio in discovery gardens. I have taken it on 4 cheques. My 3rd cheque is from this month, mid of April until mid of July.
I have been transferred to Amsterdam and need to report on duty from June. I have informed the real estate for early termination.
They told me that beside this cheque, I need to pay 2 months rent plus 1000 penalty.
Can you advise how much do I have to pay for early termination as per the law?

Premature termination of a tenancy contract by a tenant due to an emergency

Q: My landlord/agency may be filing a case against me in court over a rental contract.
I broke my contract as I lost my job. He has 2 cheques with him, however, I gave him 2 months' written notice on emergency grounds as I lost my job and visa.
He insists that I should pay 1 or 2 months penalty fee.
Please advise me further.

Tenant gave early notice but stayed: Can I change terms to prevent early termination?

Q: Dear Sir/Madam,
My tenancy contract states that there is a two-month notice period and a two-month rent penalty for early termination.
After four months of the contract, the tenant gave me an email notice saying that he was opting for early termination, but then he chose to continue with the contract on the date when he was supposed to vacate.
Can I allow him to continue on the condition that the early termination clause will no longer be available to him and that he must complete every yearly contract that he renews going forward, since his words cannot be trusted anymore and his actions have upset my plans and resulted in hardship for me as the landlord?

How can I reach a settlement with the bank for a mortgage of a jointly owned property? 0
I have a jointly owned property in Abu Dhabi. The mortgage was defaulted on as I had to leave the property with my children following an assault by my ex-husband. He left the country in 2018 and never paid the mortgage.
As I was in the country, the bank filed a criminal case against me, and I was sentenced to 3 years. I won the appeal against the bank and then filed another criminal case a few months later in Dubai. Again, I won and paid a fine.
In 2019, the bank started a civil case against me and my ex-husband to have the property repossessed. However, at the time of the purchase of the property, there were no Title Deeds, the bank requires this.
I cannot give them the Title Deeds to sell the property and pay back the amount owed to them as my ex-husband refuses to provide a POA. The bank has filed another criminal case against me only for our jointly owned property.
I wish to resolve this and pay off the bank and receive any money left from the sale. How can I resolve this issue of the Title Deeds?

Can a real estate agency hold a percentage of a property sale until transfer is done? 0
A real estate agency has signed an MOU stating that a 10% security deposit from the buyer and the seller will be kept in the real estate agency and will be released upon transferring the property.
The transfer of the property was blocked due to the court order.
According to my colleagues, the real estate agency is not a trustee and they are not allowed to have taken my security check in the first place, is this correct?
