Q: Good afternoon, I have a few questions regarding my upcoming labour case. My contract was unlimited and my employer falls under the immigration authority, where I worked for 3 and a half years and I have a claim amount of AED 36,000. I have filed a labour case for unfair termination and I've had my case registered through Adheed Centre. They have filed my complaint and given me my case number and now I have been asked to attend a first hearing on the 7th of July and I've been told that it will be a remote hearing. I just wanted to know if possible what the procedures are for this remote hearing and how it will be and if it's necessary to have legal representation for my labour case? Having seen the people in the Centre, I am pretty certain a good number of them can not afford a lawyer as well. So in case they don't speak Arabic and don't have a lawyer present, how will the hearing and case proceed?

Q: Hi, My labor case has been going on for 6 months now. The hearing started in Jul 2019. Dubai Court kept on conducting hearings until I received my first judgment in Nov 2019. However, it was later changed to (For Investigation) and Adheed Centre advises that I must bring a witness to the court. I did bring a witness to the court during the hearing and the judge asked my witness questions and the other party witness as well. The following hearing was in Dec 2019 and the judge pronounced another judgment schedule in Feb 2020. My demand was just my End of Service Benefits which is About AED 45,000. My questions: a) Why was not my first judgment in Nov 2019 executed instead of asking me to bring a witness? b) Why does it take 6 months for my case? c) Could this judgment in Feb 2020 be my final judgment? d) If so, how long would it take to receive my End of Service benefits money? Q: Hi sir, I am working in a Dubai based company. I filed a labor case against my company. I got a judgment in my favor. After that, I filed an execution. Now, I got some emails that the court has sent letters to various departments to execute the amount. Now my question is: If there is no amount or property available under my employer's name, what will be the next procedure? As I know, there is no property in my employer's name, and my employer is not in the country for the past 2 years. The company is also closed. One more thing, some payments have to come from Dubai Municipality to my company due to incompletion of a project. They did not release the payment during that time. Is there any possibility for the court to request DM to release payment against my case? Please advise!

س: السلام عليكم، الاستفسار عن حكم عمالي داخل دولة الإمارات. رفعت شكوى عمالية من شهر ٨/٢٠٢١ وصدر حكم لصالحي بمستحقات ٨ أشهر بدون راتب. تم الاستئناف على الحكم وبعد ذلك صدر حكم آخر لصالحي بنفس المبلغ. فتحت ملف تنفيذي بالفعل وصدرت الخطابات بالحجز على الأموال والمركبات وغيرها وذلك في شهر ١٠/٢٠٢١. بعد طول فترة عدم تحصيلي المبالغ المستحقة لدى الشركة، أرسلت مخاطبة ضبط وإحضار لمدير الشركة وحتى الآن أيضًا لم أحصل على مستحقاتي مما ترتب عليه كثره الديون. ماذا أفعل لتسريع التنفيذ وتحصيل مستحقاتي أم ضاع رزق بناتي؟ علمًا بأن الحكم صدر بمبلغ ٥٤٠٠٠ درهم. الرجاء الإفادة!

The provisions of this Law, known as "UAE Labour Law", govern the relationship between employers and employees and other labour matters in the United Arab Emirates. There are special labour related regulations applicable in some of the free zones in the UAE.

This Decree sets the rules and conditions for the termination of fixed-term (limited) or unlimited (not term-bound) employment contract between employer and worker in the United Arab Emirates.

The provisions of this Decree-Law, known as "New UAE Labor Law", govern labour relations in the private sector of the United Arab Emirates. The New Labor Law repeals the previous UAE Labor Law (Federal Law No. (8) of 1980).
