Q: The employee was being terminated due to the non-availability of projects (Project-based) but under unlimited contract.
He has 32 days as an unused leave. Article 5 of the Labour Law mentioned that accrued annual leave shall be paid on the basic wage, while Article 79 mentioned that it shall be paid on the wage basis.
Please give clarification on this to avoid disputes. Shall we pay him basic only or plus allowance?

Eligibility to accrued annual leave at the completion of a limited contract

Q: My limited labour contract will expire on 24th January. I don't want to renew my contract. My 2 month notice period also ends on 24th January.
I have one month of accrued annual leave still to take, but the company has not given me leave during my notice period according to the UAE law.
Let me know if this is acceptable or not. Can I get 1 month leave salary without taking the leave?
I have completed my 2-year service, so am I eligible for gratuity?

Q: Hi,
Good day.
I just want to ask, the employee has more than 30 days of annual leave balance. But the employer is saying that the employee cannot take more than 30 calendar days of leave.
Is it possible, what article it is mentioned in UAE labour law?
Please advise.

After 10 months with my company, can I access leave and ticket fare?

Q: Dear Sir/Madam,
I am an employee in a private firm, and I have completed 10 months. However, my company was taken over by another company. My company provides ticket fare at the month of the joining date.
I have over 20 leaves. But my old company says that I can't take my leave; if I take it, it will be paid, and I'm not eligible for ticket fare because I have not completed one year.
Please give me a proper answer!

How to guarantee labour rights before signing the cancellation paper 0
Good morning All,
I was terminated by my company in March 2020 for not signing the unpaid leave document given to me. I was terminated on 23rd March 2020.
Once termination letter was signed, ever since then, I have been chasing my ex-company for releasing the final settlement and each time they come up with a different plan.
The last option they gave was to sign an agreement with them for 6 months plan but are not giving me any guarantee cheques and insist that I sign the cancellation papers. I want to simply take my money and leave the UAE.
They have also directed me to their lawyers now who insist that any agreement signed with the company is not required to be notarized by Dubai Courts and the company is not legally bound to give me any cheques as a guarantee.
The company that I worked for is located in Dubai and is a private organisation.

Following up on a labor case after traveling to the home country 0
After working for my employer for nearly two years on an unlimited contract as a COO of a restaurant company, my employer owes me approx 193000, not including notice period.
I have filed a case with the MOHRE. They have tried to contact the employer who has ignored the calls and is also ignoring me.
I know that I will have to escalate the complaint but, based on experience with the way the employer treats past employees and how he ignores suppliers and landlords, it is fair to assume that he will ignore this as well.
I have little options and I have to leave the country as the apartment rent paid by the company expires mid-July. If I leave, can I maintain the complaint, and what is the likelihood of getting the money owed in this scenario when I travel back to the UK?

I am a fresh graduate who has been a full-time intern with a company that only covers transportation for over a year while completing my studies. I graduated this May.
In March of this year, they offered me a full-time employment contract since I was now near completion of my degree.
They still kept me on the internship allowance (AED 1000) until I submit all documents for visa processing.
I have submitted all my documents for processing towards the end of May. My grace period after cancellation has also expired on the 25th of June.
They are still paying me the internship allowance. Now that the visa is pending on their side, shouldn't they be paying me the full salary?
I also think they should have paid me the full salary once I signed the contract regardless of the visa status since I was already working for them.
Please let me know whether I should push the company to pay my full salary since the time I signed the contract (March) or only since this month (visa pending on their side)?
