Q: My friend left the UAE for family emergency reasons and had a loan debt remaining to the bank. He continued to pay the instalments for the next 3-4 months but could no longer because he did not have full-time employment. He kept in contact with the bank and let them know his situation. He only has part-time work while looking for full time and offered to make small payments to show good faith until he is able to secure full-time work. Now the loan is with a collection agency which is requesting a large sum or they will pursue legal action in the US against him. He wants to pay but due to his situation, he is unable to at this moment. They refused his smaller amount of payment offer. He does not plan on travelling back to Abu Dhabi. The question is, he is trying to pay but they will not accept that amount. Why will they not take the amount offered since he is communicating and wants to pay? What can they do to him in the US? How will that help them get their money back?

Q: I had some credit card loans unsettled when I left the UAE 7 years ago, but promptly, I was paying instalments when I was there. Now if the UAE bank brings the civil case verdict to India (now the verdict can be executed in India), can I go for appeal in the higher courts of India against this verdict which was issued in the UAE, because this verdict had been given in my absence? So I need a fair trial again in India in the high court. Is it possible?

Q: Hi Harry, I'm lucky you are online. I'm a GCC citizen and worked in the UAE until a few years ago and went back home. I still have a housing loan which I have been paying instalments regularly. The bank called me and asked why my salary was not being deposited into my account for the last 3 years. When I told them I had left, they insisted I go to them and they change my account from a salaried to an international account and in the meantime, my account would be frozen. I'm worried if I go back they will force me to accept higher payments when the account is converted and I desperately need advice on how to deal with this. Can they put a travel ban on me if I don't agree to pay a higher rate?

The provisions of this law, promulgating UAE Civil Code, govern the civil transactions in the United Arab Emirates. The commercial transactions remain subject to the laws and regulations applicable in their regard.
