The same case is filed in both the UAE and India. How can I get one dismissed?

Dear Sir/Madam,

Someone has filed a case against me in both India and the UAE on the same matter. Is this not considered a conflict?

How can I get one of the cases dismissed?

Dear questioner,

You should obtain an official copy of the case filing documents, endorse it, have it attested by the Ministry of Foreign Affairs and the embassy, and then submit these documents to the court where you wish to dismiss the case.

Include a memo explaining that this case is already being processed in another country by another court of jurisdiction, as evident from the enclosed supporting documents.

For more information, please contact us on WhatsApp.

Dear Questioner,

It is possible for an individual to file a case against you in both India and UAE on the same matter. This is not considered a conflict as long as the case is filed in accordance with the laws and procedures of each country.

To get one of the cases dismissed, you will need to consult with a lawyer in both countries to determine the best course of action.

In UAE, you may need to file a motion to dismiss the case based on the principle of lis pendens, which means that a case cannot be pursued in two different jurisdictions at the same time.

However, the success of this motion will depend on the specific circumstances of your case and the laws of the UAE.

In India, you may need to file a petition to stay the proceedings in the Indian court, citing the ongoing case in UAE. Again, the success of this petition will depend on the laws and procedures of India.

It is important to note that the outcome of one case may affect the other, so it is crucial to handle both cases carefully and seek legal advice from experienced lawyers in both countries.

Thank you for reaching out regarding your legal situation!

It's not uncommon for individuals to face legal actions in multiple jurisdictions for the same matter, which can indeed raise questions about conflicts.

Generally, handling such cases requires a thorough understanding of both jurisdictions' legal frameworks and specific agreements or treaties that might govern such scenarios.

To address your concern, we need to:

- Examine the details of both cases to identify any jurisdictional conflicts.

- Determine the legal grounds on which one of the cases can be contested or dismissed.

- Formulate a strategic approach to handle proceedings in both India and the UAE effectively.

I would be happy to assist you in evaluating your case and advising on the best course of action to potentially get one of the cases dismissed.

Please reach out to me directly via WhatsApp or phone at [---------], or email to discuss your situation further.

Dear Questioner,

You must bring a notarized certificate of the existence of a case in India with the details of the opponents and the matter.

Dear Questioner,

You have the right to request the closure of the UAE case by citing the ongoing case against you in India, which involves the same matter.

To support your defense, you will need to provide proof. However, the UAE Public Prosecutor retains the right to continue investigating the matter, even if there is a case in India, as long as they believe the UAE court has jurisdiction.

If you receive a judgment in the UAE, you can use it to settle the case in India.
