Early termination of a tenancy contract when the landlord is not responsive
I want to early terminate my tenancy contract of one of my nurseries in JLT (retail unit) as the business is completely shut since March. I am unable to contact my landlord who is a Chinese national; he does not reply to email or call and may not be in Dubai.
The final cheque is due 01 May 2020, what should I do?

First, you have to examine your contract and ensure that the contract has no reference to force Majeure cases.
The law is defining that the rent shall be paid for using the unit, if you are not using the unit, then the landlord shall not be able to claim rent due to the closure of the business.
You shall serve the notice through the legal means and ensure it is according to the contract.

If the landlord doesn’t reply to your emails or calls, you can send him a legal notice and after that, open a case in RDC to submit the key.

In the event of early termination of the tenancy contract, you have to compensate the landlord with 60 days of rent.
Further, if he is not responding to your calls and messages, then you can file a case with RDC and submit the keys there.

In this case, we should draft and serve your landlord with a legal notice of your intentions to terminate the lease early. Thereafter we can file a claim with the Rental Dispute Center and submit your keys.
