الإنهاء المبكر لعقد الإيجار في حالة عدم رد مالك العقار

أرغب في إنهاء عقد إيجار إحدى دور الحضانة المملوكة لي في أبراج بحيرات جميرا في وقتٍ مبكر (وحدة البيع بالتجزئة) حيث توقف العمل تمامًا منذ شهر مارس. لا يمكنني التواصل مع المالك الذي يحمل الجنسية الصينية؛ إنه لا يرد على رسائل البريد الإلكتروني أو المكالمات وقد لا يكون داخل إمارة دبي.

سيكون الشيك النهائي مستحق السداد في 1 مايو 2020، ماذا أفعل؟

Dear questioner,

First, you have to examine your contract and ensure that the contract has no reference to force Majeure cases.

The law is defining that the rent shall be paid for using the unit, if you are not using the unit, then the landlord shall not be able to claim rent due to the closure of the business.

You shall serve the notice through the legal means and ensure it is according to the contract.

In the event of early termination of the tenancy contract, you have to compensate the landlord with 60 days of rent.

Further, if he is not responding to your calls and messages, then you can file a case with RDC and submit the keys there.

But the landlord does not have a physical address that I am aware of - will the legal notice be sent to the email mentioned in the tenancy contract?

Has it to be sent from a legal firm?

Also to file a claim in RDC, I need to deposit 3.5% of the annual rent amount with RDC?
