Q: Hi,
I live in Abu Dhabi.
My landlord lost one of the rental cheques. I have a receipt and a Tawtheeq of when I handed them over to him.
I told him to go to the police and file a lost report and then I can issue a new cheque to him but he states that this will take too much time.
He suggests that he gives me a paper saying that if they find the cheque they will return it to me and to give them a new cheque.
Please note that it's a company managing my landlord's properties.

Bounced cheque case by the landlord after paying the rent

Q: I had given a cheque to my previous landlord which got bounced. Later, I had paid the amount by cash in his bank account and have handed him over the bank receipt as well.
I do have a copy of the bank receipt signed by his manager also. Although the money is paid, he didn't return me the cheque and rather lodged a police case of cheque bounce.
Also, he has given me a clearance certificate against the flat. What can I do when I am not in fault?
Kind advice will be highly appreciated.

Clearing the case of a bounced guarantee cheque after payment

Q: I gave a guarantee cheque for one person. He filed a civil lawsuit against me, but I went to his office one year ago and paid the full amount with cash, in his office.
I got the receipt from his office that I paid them against that cheque, but they didn't return my cheque because they made an excuse that it's lost and they can't find it and give me the receipt.
How can I close this case now?

How to check the status of a case at RERA from outside the UAE

Q: My ex-landlord opened a civil case against me for what should have been opened in RERA rental disputes.
I had to urgently leave the UAE during COVID-19 and relocate back to the USA and have no idea what happened with the execution of the court case and if there is a travel ban on my passport.
How can I check my status prior to coming back to the UAE?

Can I re-open criminal and civil cases for fraud after withdrawing them?

Q: I filed criminal charges of fraud against a Dubai resident in 2018 through a UK debt collector. The debt collector told me the criminal case had not been accepted, and so did the defendant. The debt collector may have filed a civil case.
The defendant promised to pay me back and pressured me into withdrawing the civil case. I agreed and signed a waiver to withdraw the civil case. He sent me the waiver to get notarized. I live in the UK.
However, I now suspect that the criminal case may have actually been accepted after all (without my knowing) and that the defendant tricked me into waiving my criminal and civil rights so that the court would be lenient.
What can I do now? I would never have signed the waiver had I known the criminal case had been accepted.
I presume I cannot file the same charges again?
I have evidence in whatsapp chat of him saying there was no criminal case accepted.

Can I face jail time for failing to pay rent after missing court-ordered installments?

Q: Dear Lawyers,
I failed to pay rent in Sharjah to my room owner, and he filed a case against me. The court initially ordered me to pay in installments, but I failed to pay.
Now, the police have arrested me again for this case.
Is there any chance of jail punishment for me by the judge?

Reducing the salary of an employee before termination 0

I have been working in a private company in Dubai for the last 13 years under an unlimited contract. Recently, they have made my position redundant.
I am now serving 3 months notice period as per the labour contract (2 months already served, I am now in 3rd and last month).
My employer has put me on forced paid leave to adjust my notice period against leave days balance. I need some clarification per below, please.
1. The employer is paying me a full salary for a notice period of 3 months. However based on the recent announcement from the Ministry of Labor (for Private Co. employees), can my employer reduce my salary temporarily/permanently in this last month of notice period?
2. If the answer to question 1 is YES, how will it impact the calculation of my end of service benefits like gratuity or leave balance encashment? Will it be recalculated based on the revised (reduced) salary?
3. Am I eligible to claim any other Termination/redundancy pay apart from gratuity and leave balance encashment?

Getting the amount of a bounced cheque after car buying fraud 0
I sold my car and the buyer gave me a cheque. The cheque bounced because the account is closed. He is doing this as a regular business.
I have already filed a complaint to the police station and I'm waiting for the judgment from the court. Maybe he will get the fine only.
How can I get my money?
Which case should I file: a civil case or a car buying fraud case?
He may not have anything under his name. If a civil case is filed against him, he knows how to avoid this case .This person has more than 14 cases. Recently, he got out of jail. The issuer of the cheque is a local Emirati guy.
