Q: Asalamu Alaikum
I am an Indian women married in the UAE to an Indian man. He sent me to India for my delivery and didn't give me any money for delivery.
It's been more than 5 months and still, he is not ready to apply for a visa for me and my kid. Whenever me or my dad ask, he says he is busy with work.
He is neither calling us from the UAE nor giving us any money.
Can I put abandonment case on him? What is the procedure for it? Can I file the case from India?

Claim against husband for restitution of marital rights

2
Q: I am a Hindu married in India in Dec 2017. I came immediately to Dubai with my husband who is an NRI born brought up in Dubai. Soon I was pregnant, was sent to India for abortion against my will around Jan 2018.
I came back to Dubai but my husband who stays with his parents insisted I go back for a few more days to India and sent me back around mid-February 2018, after which he cancelled my visa since he has abandoned me and wants a divorce.
He says he has no money and cannot afford a separate house, his father is wealthy but he is a self-made person. My parents are refusing now to keep me any further at their home in India.
How can I stay now, even forcibly, with my husband in Dubai? My inlaws who are hand in glove in the matter with my husband say that it's their house and will permit only their son, not his wife.
In such circumstances, what are my available options to legally force myself to stay with my husband?
No divorce petition is filed as yet and I will never give a divorce to him.

Legal action against the husband for abandoning wife and child

Q: I am a resident of Dubai. I want to ask about my husband who brought me from Dubai along with my 3-year-old son by fraud to spend a vacation in Pakistan in Dec 2019.
He forcefully took over child passport and other documents of UAE visa and left us alone in Pakistan and runaway back to UAE.
I am on an employment visa and my son is under his father's visa. I need to come back, but my husband is keeping the passport in Dubai with him and he is not ready to give it back to me.
I am stuck in Pakistan as I need to bring my son to UAE. Now he threatens that he misplaced all my personal belongings; my gold, jewellery and important documents in my absence from home in Dubai.
He wants to divorce me in Pakistan; that's why he is forcing me to stay in Pakistan so I cannot file a maintenance and child care claim in Dubai.
If I come back to Dubai, can I get help to get my son's passport from him in order to bring him to the UAE because the child can't live without his mother?

Filing a case against a husband residing in the UAE while being in home country?
3
Q: As-Salaamu Alaikum Sister,
Quick questions regarding my sister:
My sister is currently married to a UAE resident (from Pakistan). They got married (Nikah) in Karachi, Pakistan. Then he applied for her visa and they started living together in Dubai since he was already living there.
They lived together in Dubai for about a year. He recently sent my sister back to Karachi, Pakistan after saying that he does not want to live with her, and right after he sent her to Karachi, he canceled her visa as well.
They are still married but he is not giving her any expenses at all. He also divorced a girl several years ago. He is not directly telling my sister that he wants to divorce her but keeps telling her that he can’t live with her.
Should my sister re-apply for a visa and go to Dubai to pursue her case there for better legal actions/results?
What kind of alimony will my sister be eligible for?
Any suggestions.
Thanks and I look forward to booking a session to chat further.

How can a wife claim her rights from ex-husband after divorce and leaving the UAE?

0
Q: Assalamu Alaikum
I am a Pakistani woman currently living in Pakistan. I am stuck in a case where I am already divorced by a man, who is currently living in Dubai, 7 months ago after 4 years of marriage.
I also lived in Dubai after marriage for a few months on & off. The main issue now is his family in Pakistan & him in Dubai are not giving me back my dowry, my Haq Mehar & maintenance amount (which a woman can claim for not giving her a penny as a monthly allowance for years during marriage).
They are demanding to return 3 gold sets to them first which they have given me as a gift at the time of the wedding & engagement. I am not obliged to do so as they are mine now according to the shariah law.
I would have given them back if they were good poor people. I don't feel like fulfilling their illegal demand as they have ruined my life.
If I file a case in Pakistan to claim my things back, can the UAE's law help me out too to pressurize him to do the right thing?
Thank you

If someone has a case in the UAE, can they travel to another GCC country? 2
Hi.
One of my friends joined a Telegram group. They said, "We will transfer some amount to your account, and your task is to transfer this amount to another account. Once the task is completed, you will get 30 or 50 AED per task."
He completed 3 to 4 tasks, but he realized it was not good, so he stopped. After one week, when he opened his account, it was blocked, and the bank said, "We are conducting an investigation; after this, we will let you know."
After some days, he had an accident and went to his home country. He then received a call from a landline number, which was from the Abu Dhabi police station.
They said, "We have received a complaint against you; come to our investigation department." However, due to his surgery and treatment, he could not go.
After some time, his bank account was reopened, and he did not receive any further calls. I want to know, if he comes back to the UAE or goes to any other GCC country, will he face any problems?
If someone has a case in the UAE, can they travel to another GCC country?
Please advise!

How can we locate a person with an ongoing legal case? 1
Hello,
I am seeking your legal advice regarding a friend who was previously imprisoned in Abu Dhabi. His case there is now closed, but he has another ongoing case in Dubai.
Currently, we have lost contact with him and are unsure of his whereabouts. How can we check where he is or access any other legal facility?
Are there legal procedures to locate a person with an ongoing case?
What steps should we take to get more information about his status and legal position?

Can I be convicted of driving under the influence even if the alcohol test came back negative? 0
Hello,
I was driving my car when the police stopped me at one point on the road and told me that I was driving under the influence of alcohol.
I tried hard to deny that because I had not actually consumed any alcoholic beverages that day or in the previous three days.
However, a report was filed and a case was opened, but the alcohol test report came back negative. Will I be convicted despite that?
Please answer me. It is urgent.

Can we legally claim unpaid dues for food supplies based on emails and invoices? 0
Hello,
We have an agreement with a company to supply food for their buffet on a daily basis, with invoices to be issued monthly and payment to be made every three months.
The relationship actually lasted for nine months, and payment was made for two periods. In the third period, due to disagreements between our company and the company to which the supply was made, they refused to pay, noting that the outstanding amount so far is fifty-four thousand dirhams.
Can we claim the amount, noting that the agreement is not written, but there are emails exchanged between us and invoices?

A hair salon caused serious damage to my hair and scalp. What can I do to sue them? 0
I’m looking for legal advice regarding a hair salon incident that caused serious damage to my hair and scalp.
I visited a salon for a colouring treatment, during which two rounds of bleach, which is not what I booked in for, were given to me without proper approvals, and were applied back-to-back without a strand test or proper consultation.
As a result, I’ve been experiencing extreme hair breakage, daily hair loss, and ongoing scalp irritation. This has been especially distressing as I’m currently pregnant.
It’s now been over 20 days since the incident, and despite multiple polite follow-ups, the salon has ignored all communication.
I’m now exploring legal action to pursue compensation for the physical and emotional distress caused. I have full documentation, messages, and photos.
Any guidance on the best next steps or legal routes I can take would be greatly appreciated.
Thank you in advance.

What can I do if the landlord has not been responding to renew the commercial lease contract and Ejari? 0
Good day.
For the last 3 years, the landlord's office has not responded to renew the contract, so I contacted RERA for renewal.
The office doesn't respond to emails related to renewal, even though I started sending emails and reminders 2 to 3 months before expiry, and I have no choice but to contact RERA and send a notice.
Once the renewal was processed by law, the landlord's office delayed in releasing the Ejari. Since it is a commercial property, my renewals are related to a staff visa, and I have to pay delay penalties.
The landlord's office staff tried to take advantage of the Emirati owner, and no direct meeting was fruitful.
What is the law that safeguards expats and sorts out issues without mutual compromise as they try to force their terms to be acceptable by law and not supported by any documentation?

Increasing the price of restaurant's food items on third party platforms 2
As a restaurant, we have the same price for our food items on dine-in, delivery menu, our website, and all other social media platforms like Google, FB...etc., wherever we are selling directly.
But when we are selling through a 3rd party platform, they charge a minimum 25% to 30% commission, and that is incurring losses. We want to keep our prices 20% higher on 3rd party platforms to pay for the margin.
Salespeople from these 3rd party platforms claim that it is not allowed by the UAE government under consumer protection law; Federal Law No. (24) of 2006 On Consumer Protection.
However, I read the law myself and it doesn't mention anywhere that a restaurant can't have a different price on their own website /dine-in menu via 3rd party platform.
A lot of other restaurants have different prices on their own website and a higher price on a 3rd party platform.
Can you please give us legal advice if we can have a 20% higher price on 3rd party online platforms?
Thanks!
