س: السلام عليكم
كنت محتاج أستفسر عن شيء.
أنا كنت مأجر شقة، وقبل انتهاء العقد بأسبوع أخبرت المالك بأنني سأترك الشقة مع انتهاء العقد. أخبرني أنه يريد مني إيجار شهرين لأنني لم أقم بإخطاره قبلها بشهرين.
هل هذا قانوني؟ وهل يوجد نص في قانون الإيجارات ينص على هذا؟

The penalty of breaking tenancy contract before expiry

Q: Hi,
I am a tenant and my agreement ends on 30/8/2019, but due to unavoidable circumstances, I need to terminate the contract early on 30/4/2019.
The exit clause states:
1. The penalty for breaking the contract is 2 months' rent
2. The tenant should inform the owner 2 months before vacating the unit otherwise the tenant has to pay 2 months' rent as a penalty.
Already given the owner the notice on 10/2/2019, but he is still claiming the 2 months' rent penalty.
Please clarify how many penalties are in play here.

Notice for non-renewal of the lease contract by the tenant

Q: Dear lawyer,
I have a tenancy contract for one year in Dubai, ending on 25 November 2018.
On the 8th of October, the landlord sent me a lease renewal, with some parts of the contract modified and contains different terms from the previous one.
I decided I don't want to renew the contract; neither with the new nor old conditions. On the 1st of November, I notified the landlord that I will vacate on the current contract end date 25 Nov.
He replied that I needed to notify him 90 days prior to the expiry date and I didn't, and now he is entitled to reimbursement and asks for 2 months' rent as a compensation.
Our contract says only "Tenant agrees to notify the Landlord in writing 3 months (90 days) prior to the expiry of this Agreement of his intention to renew or not renew the Agreement".
However, no financial penalties for breaking the clause of 90 days' notice of non-renewal are mentioned there.
Please tell, can he claim from me this 2 months' amount?
I will highly appreciate your opinion.

س: سؤال بخصوص تجديد عقد الإيجار لسنة أخرى.
نويت التجديد لسنة أخرى، ولكن كنت أتفاوض على مبلغ الإيجار. وافق المالك على التجديد بعد الاتفاق على المبلغ المطلوب.
فى نفس اليوم الذى أرسلت له الشيكات اضطرتنى ظروف العمل أن انتقل لعجمان وأنا أسكن فى دبي، فطلبت أن يكون العقد لمدة 6 أشهر فرفض المالك وقال أن التجديد لمدة سنة ولا يمكن الرجوع.
قلت له أريد مناقشة بند الغرامة، وكما هو مذكور في العقد القديم أنها 3 أشهر كاملة فناقشته وقال أيضًا لا يمكن تعديله.
إلى الآن لم أوقع على العقد الجديد والمالك يرفض تعديل هذا البند في العقد الجديد، علمًا بأن المالك طلب منى إرسال الشيكات كاملة للسنة وأرسلتها له بالفعل.
فهل هناك مخرج من هذة المشكلة؟

السلام عليكم،
هل يحق لي كمُدَّعى عليه في دعوى خلع وإثبات حضانة أن أتقدم بطلب إغفال لمحكمة الموضوع؟
حيث أن المدعية طلبت الحضانة فقط في مذكرتها الشارحة ولم تطلبها في مذكرتها التعقيبية والختامية وأنا في دعوتها كنت أنازعها على الحضانة وأطلبهم.
القاضي أثبت وقوع طلاق بائن ولكن لم يذكر أي شيء بخصوص الحضانة واكتفى بأن المدعية لم تطلبها في المذكرة الختامية. فماذا عن طلبي أنا كمُدَّعَى عليه؟
هل يحق لي عمل طلب إغفال أم أطالب بالحضانة في الاستئناف أم دعوى جديدة؟

What to do to convince the bank of a settlement offer 1
Hi,
I've been out of work since September 2019 due to company restructuring, though I work there for more than 13 years.
As of now, I still have a debt of 170k (150k as principal) with Bank M and 19k (8k principal) credit card debt with Bank F.
I already contacted Bank M that I'm willing to settle the loan but if they could bring down the amount to 70k as I only have 40k on hand while I haven't talked to Bank F yet.
Is there any way that we could bring down the amount?
I still don't have any work until now and I'm just on wife support.

اشترى أخي شقة من الباطن من المالك لأن أقساطها لم تُسدد بالكامل ودفع له ثمنها المُتَّفق عليه ثم ضاع العقد من أخي والشقة لم يسكن فيها حتى الآن.

Hi,
I am a non-Muslim indian expatriate, residing in Dubai since 2015. The first 5 years, I was on a working visa, and after the delivery of my first baby, I left my job and became dependent on my husband.
In 2018, we bought a house together where I invested AED 2 hundred thousand from my income (I have proof in the form of a cheque). I also paid AED 3300 monthly installment for 1 year, for a personal loan taken out for the house.
But in spite of my resistance, my husband tactfully put the house in his name, so the title deed was in his name. In 2024, when my kids and I were in India for vacation, he cancelled our visas and residency. He also filed for a divorce in India.
The divorce is not yet finalised, and we are still married. Since August 2024, he hasn't let me access my house in Dubai, so I filed a case, which eventually went in my favor in January 2025.
Since I used to travel on a visit visa, I left for India and returned in March, to find out that my husband had already sold the house. The new owner is residing there.
What can I do now?

Can the employer force the housmaid to work for unlimited hours without rest? 0

I'm a nanny, and at the same time, I work as a housemaid (khadama) here in the house. I work, but as I know, the nannies and housemaids have different rights, and my employer doesn't give me rest.
My work starts at 7:30 am and then finishes at 10 pm or less. It depends on whether the baby is asleep or what time they will take on me if not yet asleep. Is this right?
Also, at the time of eating, I'm still working because the baby is with me, so I just let her sit in her chair. That's how I eat.
Please answer me. I want to know my rights.
Because if I can leave during the 6-month probation, I want to take it if the employer is this kind. I don't know.
They are also expats, but they don't follow the rules of the UAE regarding a housemaid.

My previous organization has not yet released EOSB because I contacted a client. Is this legal? 0
I recently joined a new organization in the Hamriyah Free Zone, and my previous organization has not released my end-of-service benefits.
The HR has instructed the finance team not to do so because I had contacted one of their clients.
In my DMCC contract, there is no Non-Compete clause, but the offer letter has one, and now they are not releasing the end-of-service.
Is this legal? What are my rights?

I have multiple cheque execution cases filed against me due to financial strains last year.
My trade license and visa will expire next month, along with my Emirates ID.
Is it possible for me to renew my license and visa along with EID prior to settling the execution cases?
The trade license and visa were issued by the free zone authority.
