1
Q: Hi,
On the 29th of March 2017, my UAE (Abu Dhabi) visa has been cancelled by my employer and I never put my signature on papers to cancel the visa, due to my outstanding dues (AED 82000).
But they had put my signature to cancel my visa. Thereafter, they have transferred me to Qatar and said we will settle your outstanding dues soon, but still, they have not settled the said amount.
Now, I'm camping in Dubai with the help of a one-month visit visa to receive my outstanding dues. My employer is saying to go back to my hometown and they are promising that every month they will send AED 10000 to my account.
However, this statement is not acceptable to me. I need my whole outstanding dues in one payment.
Kindly advise me.
Thanks,
Ramaswamy Nadar.

Forging the employee's signature on the labour cancellation application

4
Q: FORGED SIGNATURE ON LABOUR CANCELLATION
The labour card/work permit of my friend was cancelled without his knowledge. He learnt that he was cancelled when he checked in Tasheel Centre.
This is very clear that his employer forged his signature on the Labour Cancellation Application.
How to file a complaint and where he will report it, directly to the police or through MOHRE?

Can the employee refuse to sign visa cancellation form before retaining his passport?

2
Q: I have been disputing with my employer to release my passport as I have informed them that I will not sign the cancellation forms for my residence visa till I get my passport in my possession as I'm aware that the employer has no right to retain my passport for whatever reason.
The employer stated that they will only release my passport when I sign the cancellation form plus show them that I have received my new visa or leaving the UAE within the 30 days grace period.
I have repeatedly informed them that they don't have the right, but they keep telling me it's a new procedure that they need to hold my passport till I get a new work visa or leave the country within the grace period.
In my offer and my labor contract, there is no statement or I have given them a written consent in the first place to hand over my passport.
Please advise if I can open a case with regards to this.

My employer is holding my passport and won't let me go on leave. What can I do?

1
Q: Dear Sir/Madam,
I have been working in Dubai since November 2022, but my employer applied for my visa at the end of December and I received my MOHRE contract and residency in early January. It is a limited contract.
In February, our employer made us sign an offer letter that has different clauses than the MOHRE labor contract. When I asked the employer, they said it was just a formality for our own personal records.
The labor contract and the offer letter both have different clauses (pay, allowance).
The offer letter also states that the company can hold my passport, and even if I complete my probation or work for 23 months and 28 days (before 24 months), I will have to pay them the visa fee if I resign.
I wanted to go on leave due to family matters involving my mother's health, but my employer is not allowing me and is holding my passport. Can they do that?
Secondly, if I resign without a notice period, am I liable to pay for the visa fee (based on the offer letter)? What if I don't pay? Can they ban me on this basis?

The employee refuses to sign the cancellation papers after the payment of dues. What to do?

0
Q: An employee resigned to join another firm, received all her dues, and signed end-of-service entitlements, yet she refuses to sign the labor cancellation paper because she wants us to keep her visa valid until she passes her probation with her new employer.
Is there a way to cancel her labor card and visa without her signature?

If someone has a case in the UAE, can they travel to another GCC country? 0
Hi.
One of my friends joined a Telegram group. They said, "We will transfer some amount to your account, and your task is to transfer this amount to another account. Once the task is completed, you will get 30 or 50 AED per task."
He completed 3 to 4 tasks, but he realized it was not good, so he stopped. After one week, when he opened his account, it was blocked, and the bank said, "We are conducting an investigation; after this, we will let you know."
After some days, he had an accident and went to his home country. He then received a call from a landline number, which was from the Abu Dhabi police station.
They said, "We have received a complaint against you; come to our investigation department." However, due to his surgery and treatment, he could not go.
After some time, his bank account was reopened, and he did not receive any further calls. I want to know, if he comes back to the UAE or goes to any other GCC country, will he face any problems?
If someone has a case in the UAE, can they travel to another GCC country?
Please advise!

How can we locate a person with an ongoing legal case? 0
Hello,
I am seeking your legal advice regarding a friend who was previously imprisoned in Abu Dhabi. His case there is now closed, but he has another ongoing case in Dubai.
Currently, we have lost contact with him and are unsure of his whereabouts. How can we check where he is or access any other legal facility?
Are there legal procedures to locate a person with an ongoing case?
What steps should we take to get more information about his status and legal position?

View allHow to get the security deposit from landlord after finishing all proceedings? 0
The landlord has not returned my security deposit worth AED 5000. I filed a case and have judicial announcements that the landlord should return deposit+expenses. But still no response.
The landlord is out of the UAE and his property is handled by the agent. Not sure how to get my money back while I followed all procedures, even filed an execution case but no response.
While I keep paying to follow up on the case, the property is rented out to the next tenant and earning money. I feel like this system is created like this on purpose.

Is it possible for the employer to drop a case filed by employee in free zone? 0
I filed a complaint to SHAMS regarding unpaid salaries.
My employer drafted a contract saying I should drop the complaint within a week. If I fail to do so, they have the right to do it themselves.
Is this acceptable?

Winding down an LLC company and the liability of the manager after absconding 0
Hi there Michael,
I am a 24% shareholder in an LLC wherein the other shareholders are our local partner with 51% shares and the partner who is listed as manager on the trade license with 25% shares.
The manager has absconded leaving behind unpaid VAT and other debts that are well over 30 days due (up to a year). No proceedings by creditors have been filed against the company and the MOA contains a general POA in favor of the Manager.
I would like to wind down the company without going through bankruptcy procedures. My understanding is that the listed manager of an LLC is personally liable for the Company's debts.
I need advice about the procedures required to wind down the company. I do not wish to go through bankruptcy procedures as the finances and management of the company were being handled by the manager. I am just the creative director of the LLC.
Please advise as soon as possible.

Bank filed a civil case over a loan: Better to settle with the bank or in court? 0
Good day, Sir,
I have received a message from the Dubai Court stating that a bank has filed a civil case against me. The loan has been pending since February 2019.
I cleared the cheque bounce case earlier with a court fine in 2019. I am looking forward to a minimum settlement plan with the bank. The outstanding amount was around 70,000 AED, and now the message is for 115,000 AED.
What will be the best way for me to proceed: approaching the bank or dealing with it in court?
Best regards,

Demanding that an employee pay for visa charges a year after resigning 0
Dear Lawyers,
I worked at a bakeshop here in Dubai. I resigned exactly one year ago. Now they want me to pay for visa charges, as stated in the offer letter.
If I cannot pay for the charges, my employer will claim financial loss due to the damages, estimated to be at least 7,000 AED.
What should I do about this? My monthly salary is only 2,800 AED.
