Q: Dear Mr Khalifa I have recently resigned from my company in Dubai where I have worked for over six years. Currently, I am serving the notice period up to 30th June 2019. I resigned on 11th June 2019 but my company is asking me to serve 30 days notice period. The reason for leaving is they are not paying me my salary on time which has now increased to almost three months. My dues include 3 months salary (April, May and June 2019), 6 years gratuity and 10.5 days annual leaves. The total amount due is around AED 115,000. When I asked my company to cancel my resident visa (which is already expired on 22nd June 2019), they have sent me the final settlement which states the following declaration: "I, the undersigned do hereby certify that I have received all my dues from my Company/Institution and I have no right to make any claim after this date." I told my company that the dues are not cleared yet, how can I sign this form? but they are saying that this form will not affect my dues. Please advise.

Q: I work for a company in IMPZ Dubai. I resigned on June 23 & my last working day was on July 22, 2018. My employer has not paid 2 months' salary & gratuity till date. The company forcefully asked me to sign the cancellation paper and my visa got cancelled on  August 16. I have an email from the vice president of the company dated August 24 confirming that my settlements will be paid soon, and they mentioned in my settlement calculation that my dues will be paid upon visa cancellation, as this is their company policy. Few other employees have left the company recently & the management followed the same process. i.e. visa cancellation first and then settlement of dues. Kindly advise, how can I get my rights?

Q: I got a new job in Dubai and I resigned from my current company in Dubai. There is a salary delay of 3 months in my current company. I have a few questions to ask. 1. My company stopped processing my pending salaries once I resigned. As per them, all the pending salaries will be paid along with final settlement only. Is it legal? 2. If I am signing the end of service document to cancel my contract before getting the settlement, can I move legally later if they are delaying the final settlement further? Hope you answer soon. Q: Hi, I am working for a company in Dubai that has a trade license registered both under the mainland and in the free zone. My work permit was under free zone for the last 06 years and now they have requested me to cancel the free zone visa and get the new work permit under the mainland. They have forwarded me a document from Tecom to proceed with the cancellation, stating that I have received all my dues as part of gratuity. However, the mitigation company has given a service continuation letter stating this is just an internal process and I have not received my dues. Is this enough to protect me legally from any dispute that may occur in the future, or do I need to ask them for a notary attestation of the outstanding dues to get more protection from a legal perspective? Q: My company is having Hamryaa free zone company. I am on their visa. But my workplace was in Dubai (with their head office). My contract expired on Aug 13 and still, I am not paid my 5 months' salary and other settlement. Now they are asking me to sign the paper for cancellation. My dues are not paid and said they will give a monthly basis. But I am going back to my home country. What to do? Can anyone help me, please?

Q: Hi! Good day! It has been almost 4 years of working as a security guard in a Dubai-based company on a limited contract and recently I got a job offer overseas (Malta). In order to get the visa, I need a No Objection Letter from my employer, which the employer rejected. So, Is there any way to get NOC from my employer? Or does the MOHRE or Labour Court issue the NOC on the employer's behalf?

This Decree sets the rules and conditions for the termination of fixed-term (limited) or unlimited (not term-bound) employment contract between employer and worker in the United Arab Emirates.

The provisions of this Decree-Law, known as "New UAE Labor Law", govern labour relations in the private sector of the United Arab Emirates. The New Labor Law repeals the previous UAE Labor Law (Federal Law No. (8) of 1980).
