Q: I have a friend renting a flat but there's no contract between them. He issued a cheque as a guarantee cheque only and they agreed that they will give it back to him once he pays the rent. Q: I gave a guarantee cheque for one person. He filed a civil lawsuit against me, but I went to his office one year ago and paid the full amount with cash, in his office. I got the receipt from his office that I paid them against that cheque, but they didn't return my cheque because they made an excuse that it's lost and they can't find it and give me the receipt. How can I close this case now?

س: حررت ٣ شيكات (كل شيك بقيمة مليون ومائة ألف درهم) من الشركة باسم شخص وسيط كضمان، حيث وعدني بتدبير عقد مجزِ من جهة كبيرة - الوسيط لديه معارف ولا يعمل بالجهة. لم يتحقق العمل ولم يتحصل لدي المبلغ أصلاً فلم أستفد منه شيئًا. أخاف أن يقدم الشيكات للمطالبة القانونية. ليس لديه دليل على أنه قام بالعمل وأتمَّ الصفقة (لا عقد ولا فواتير ولا اتفاقية)؛ مجرد الشيكات بيده. كيف يمكنني إنهاء الأمر؟ هل أطالبه بالشيكات؟ أخاف أن يثور ويفعل ما أخشاه! وماذا إن قدم بلاغًا بهم؟ هل أكون ملزمًا؟ ما العقوبة الجزائية والمدنية لعدم السداد؟ أنا مرتبك صراحة ولا أعرف كيف أتصرف!

Q: My previous employer had a policy where we had to give him a cheque for 15,000 AED addressed to the company in order to receive the salary. This way we could not leave the company before finishing the contract. I had no choice during that period as I wanted a job badly and gave the cheque. In return, I sent an email to the company stating that I am giving the cheque as per the company's request and I haven’t taken any loan from the company. In 3 months, I got fed up with various unfair policies in this company and left. I didn’t sign a labor contract with the company as I was working on a visit visa. When I left, I requested my cheques back but got no response. Just yesterday, this company bounced my cheque. Can I go to the police and complain against this employer? What are my options now?

يلعب الشيك دوراً مهماً في الحياة اليومية سواء في ميدان المعاملات التجارية أو في ميدان المعلامات المدنية باعتباره أداة وفاء والتزام تحل محل النقود في التعامل بين الافراد. ونظراً لهذه الأهمية فقد أصبح أكثر الأوراق التجارية انتشاراً وتداولاً بين الناس، على الرغم من حداثته نوعاً ما. فالشيك لم يبق كما كان في بداية عهده أداة لسحب الودائع المصرفية لحساب الساحب ذاته، بل أصبح أداة وفاء تحل محل النقود سواء على النطاق الداخلي بالنسبة للمعاملات التي يقوم بها الأفراد داخل الدولة فحسب وزادت أهميته.

This Law promulgates the Federal Penal Code (Criminal Law) of the United Arab Emirates. Crimes and chastisement punishments shall be determined in accordance with the provisions of this Law and other penal codes.

The law promulgates UAE Civil Procedures Code (Civil Procedure Law) which governs civil procedures in the United Arab Emirates, including the prosecution before the courts, litigation and execution.

The law promulgates UAE Criminal Procedural Law (Penal Procedures Law) which governs criminal procedures in the UAE. This law applies to the procedures relating to offences whose punishments are not specified, dogma and punitive offences, and blood money, if they do not violate the Sharia rules.

The provisions of this Decree by Law amend the Federal Law No. (18) of 1993 by replacing Clause (4) of Article (379) as well as Articles (600), (617), (641), (642), (643), (644), and adding new articles numbered (635) Bis, (641) Bis (1), (641) Bis (2), (641) Bis (3), (641) Bis (4), (643) Bis (1), (643) Bis (2), (644) Bis (1) and (644) Bis (2). The Decree-Law also repeals Articles (401), (402) and (403) of the Federal Law No. (3) of 1987.
