Q: Dear Sir,
I have not paid a loan amount of AED 82000/- due to job loss. The bank is threatening to deposit a security cheque for AED 220,000/-.
How will the bank deposit more than the outstanding amount?
If the amount exceeds the cheque amount of AED 200,000/-, what is the next action by me?
Please clarify

Q: I currently have two credit cards with a debt in the UAE and have left the country due to my daughter’s health. I have been in contact with the bank and tried to make the payments.
I have emailed with no response. I finally received a response from the collection department after many emails. I told them I wanted to make the payment and asked how.
They gave a method so I made the first payment and said I would continue to make a monthly payment.
Before the next payment was due, I received another email saying they were going to open a legal case against me for not making any payments.
I emailed again and sent the proof of payment. I asked if I could still make the monthly payments and I never received a reply.
Then I get another email saying they presented my cheque, which bounced, and they were going to seek further legal action in the UAE and country of residence.
I emailed again to sort this issue but haven’t received a reply. What are my options as I want to clear this debt?

Acting against a civil case for a bounced cheque

Q: Salaam Alaikum
The bank bounced a cheque of AED 103,000 for my business partner and filed a criminal case. My partner has already paid "more" than the cheque amount of AED 106,585. We have full proof.
Only AED 53,000 was outstanding - this is mostly interest, legal charges, late charges and fines. The rest is all paid properly.
Unfortunately, this year his business had a lot of losses. As he was unable to pay the full amount, as per new Dubai laws and Police, he paid 10,000 AED fine and got the criminal case removed by the public prosecutor a few days ago.
Now, the bank told him they will file a civil case. What happens now? How many weeks will it take to get a court hearing and what's his recourse?

The credit card company claims for a big amount while the real one is much less

Q: Dear sir/madam,
I was misled by information from the credit card company, due to which they overcharged me and was unlawfully demanding the amount to be cleared even though the mistake was from their side.
They just deleted the email from their side when I highlighted they made a mistake in their communication and it wasn't my mistake.
After this, they kept on harassing me and then I stopped paying my loan and credit card asking them to clear the issue. But instead, they bounced the cheque for 65k even though my card pending was 6k and the loan amount was for 29k AED.
I now have a police case. What am I best supposed to do in this case?

أخذت قرضًا بقيمة 25000 وكرديت كارد بقيمة 5000 من شركة تمويل وقد حررت شيكًا بدون تاريخ وبدون تحديد المبلغ وكتبوا في الشيك مبلغ 100.000 بعدما تعثرت في السداد لمدة 6 أشهر.
أودعوا الشيك وأخذت رفض وحاليًا البنك عمل تنفيذ وتم الحجز على حسابي البنكي بالكامل. ما موقفي في القضية؟ وهل يمكن أن أُجبَر على دفع هذا المبلغ بالكامل أم المبلغ الذي أخذته فقط؟
مع العلم أنا سددت حوالي 7000 من قيمة المبلغ ولدي النية بالتسوية والبنك لم يتواصل معي منذ أكثر من سنتين والرقم المسجَّل لديهم مُلغى.

Can I start a dispute against a bank for overcharging without paying the full court fee upfront?

Q: Dear Sir/Madam,
I am seeking legal advice for my ongoing cheque execution case with a bank. I wish to open a dispute case against the bank for claiming more than I owe.
However, to open a substantial dispute case, the court fees are around 20,000, which I cannot afford to pay in one shot.
Is there a way to request the court to start the case with my passport as a guarantee, with a minimum amount, or to pay the fees in installments?

I need some guidance regarding a property transaction that is not progressing as expected.
My broker initiated a manual Memorandum of Understanding (MOU) between me (the Buyer) and the Seller, with an expiry date of 01/02/2025. Within this period, I successfully arranged the bank mortgage, property evaluation, and NOC.
However, the broker started giving excuses, such as the seller being hospitalized. Later, the broker attempted to arrange a Power of Attorney (POA).
However, after that, they started ignoring my messages and calls. It now seems like they no longer intend to proceed with me, and the MOU has already expired.
Meanwhile, my bank EMI has already started, and I have paid two monthly installments. The broker is still unresponsive. I have raised multiple complaints through DLD RVS against the broker, but the response has been very slow and unsatisfactory.
I’m feeling stuck and financially burdened.

I'm building my house in Dubai, and it was going well.
I gave the contractor 420k as a first payment, and we both agreed that the rest would be in installments. Just two months ago, the contractor went off the grid, and I can't find him.
