Q: Hi,
One of my employees, who has been with us for the past 2 years and 4 months, decided to resign.
The thing is we have just renewed her visa and it has only been 4 months. I know we cannot legally ask her to recover the visa cost, but is there a way we can make up for that loss?

Is the employee liable to cover employment expenses in case of early resignation?

Q: In case of voluntary termination of employment by the employee, prior to completion of the first year of service, the employee will be liable to pay back, in full, all costs incurred by the company as a part of the employment process.
Such costs may include but are not limited to the employee's relocation costs and his family, air tickets, residence visa expenses, technical training course costs... etc.
Further, the company will not be liable to bear any employee or dependents’ repatriation costs. Is this position correct?

An employer is asking for visa expenses. Is that legal?

Q: Dear sir/madam,
I resigned from my company last June 20 and served my notice period until July 29. My employer has asked me to pay for the visa expenses but I have refused to do so as the MOL told me I’m not obliged to do so.
The company then filed a case against me claiming a large amount. I will need a defense memo to answer their claim as the amount is unjustified.

My company's offer letter mentions that if I resign early, the company will require me to cover half of the visa cost.
However, my labor contract does not mention the visa cost. Now, my company is asking me to pay half of the visa cost. What should I do?

I have issued a blank cheque for my EMI, and now the company is using my blank cheque and putting any amount to deposit it.
