Asking for visa and employment charges in recruitment

Which category of companies in the UAE Dubai/Abu Dhabi is required to give an offer by requiring job applicants to pay fees for visa application and health insurance and then employers state that employees will be reimbursed for those fees?

From the above description, I understand your question as follows:

Whether a company in the UAE can demand visa and health insurance expenses on reimbursement basis?

Please note that the cost of recruitment of an employee should be borne by the employer as per Article 6(a) of the Ministerial Order No. 52 of 1989 pertaining to rules and procedures to be adopted at the labour permit sections with respect to the recruitment of non-national labour for employment in the UAE, which states:

"An undertaking from the employer to the effect that he shall sponsor and be responsible for the recruited employee, the bearing of his recruitment expenses and his employment in accordance with the employment contract in a way not prejudicing the provision of the Federal Law No. 8 of 1980 referred to herein."

Now, I have another question pertaining to the process of application of visa, for work visa and residence in the UAE.

The question is here as follows :

I have paid the fees of the visa application process for a two-year employment visa and paid for health insurance fees under the offer which states like this.

I find it normal to do so as long as the employee needs to be present physically in the UAE after being issued a visa.

Under which circumstances a visa for work and residence may be denied or rejected by the UAE authorities when all these steps have been completed?

Below are the most common reasons:

1. If you held a residence visa previously and left the country without cancelling the UAE visa.

To get approval, the PRO will have to go to the immigration department and clear your previous residency visa.

2. Visa applicants with previous criminal offence, fraud or misconduct committed in the UAE.

3. Previously applied for a tourist visa but did not enter the country. In order to get approval, the PRO of the travel agency or sponsor must go to immigration to clear the previous UAE visa.

5. Applicants who applied for employment visa via a company (prospective employer) but did not enter the country. To get approval, the PRO of the company or sponsor must go to the UAE immigration and clear the previous employment visa.

6. Visa application with typo errors of name, passport number, and profession code will see a delay in getting approval, or result in rejection of the passport.

7. If you fail in the medical test.
