Q: I lost my job in March 2020. Had a loan payment and credit card payment going with the bank.
I could not pay the loan EMI, the bank filed a case and I had to pay the fine of AED 10,000/-.
At this point, I'm still jobless and unable to pay the credit card minimum due since April 2020.
My query -
1- I don't remember giving any blank cheque for a credit card since it was issued by the bank without my request, can they still file a case?
2- In the meantime, if I get a job, can I open a salary account with a different bank?

Negotiating credit card outstandings with the bank
10
Q: Hi, I lost my job a year ago and I have an outstanding credit card of AED 300k. I've missed the last 9 monthly payments (I am negotiating directly with the bank). I am willing to settle the credit card with one lump sum payment that a friend will lend me.
How much discount on the balance of AED 300k can I negotiate to settle the matter? Should I also ask for a clearance/ no liability letter?

Defaulting on credit card payments due to job loss

3
Q: I have made payment default on the credit card for the last five months. Currently, I have a job but I have some other priority commitments back in my country and I couldn't pay the minimum amount here.
My credit limit was AED 30,000 and now the outstanding is 40,000. The bank is calling me almost all day.
What will be the consequences if I continue not to pay?
By paying the fine, will I be able to relax from this burden?
Will the bank move with a civil case? If so, what will be the consequences?

The management of individual financial affairs is crucial and all the actions must be weighed down while committing to any financial liability. Whether it's job loss that may have lead to financial failure or the opposite, one must be aware of the personal liability which will not diminish by paying fines for cheque bounce cases. There are two major types of liabilities, criminal liability and civil liability. Each has its own significance, hence, must be dealt with accordingly.

Can the tenant avoid paying early exit penalty for rent after losing job? 0
We have an existing tenancy contract in Sharjah, but due to unfortunate circumstances of this pandemic, my wife and I lost our jobs.
We already paid until December. Is there a current law where we can avoid paying the penalty of 2 months if we will end the contract earlier?

Getting a new employment visa while a cheque bounce case is being processed 3
Hi All,
I have an existing criminal "cheque bounce" case under my name for dishonoring loan payments. I'm also a victim of unpaid salaries and gratuity from the previous employer.
However, I have reached a stalemate in negotiating with the bank as they are not interested in accepting the money I could offer in the interim despite having a clear understanding of my predicament.
Finally, I have an offer from a company after all these months and I'm anticipating to accept this offer but I'm yet to resolve the criminal case!
Since the bank is not willing to negotiate, I've planned to pay the criminal case removal fee or fine to the Dubai Police. I know that the bank would immediately proceed with a civil case should that happen.
My question is how long does it take to file a civil case? And can they initiate a travel ban without appeal while filing the civil case in court?
Will it affect my capacity to get a new employment visa stamped and work in the UAE while the civil case is active?
