Q: Dear Sir, I have a question regarding my rental cheques, where two cheques got bounced recently. For the first cheque, I got arrested by the police at Dubai Airport. I paid the fine at Dubai Courts, then they released me. After two days, one more cheque got bounced and I had already requested to negotiate with the management but they didn't listen. I cannot pay now because I don't have a job. Now my question is, can I travel to my home country after paying the fine for my second bounced cheque? Please advise as soon as possible. Thank you.

Q: Due to job loss, all my CHKs (cheques) bounced & the real estate wing of a local bank in Abu Dhabi sent all the 3 CHKs to police for filing case. Q.1- The Police processed only 2 CHKs, It was good for me but the question is why the 3rd one was not processed? Is it due to SABQA FASAL? I have a feeling now that (as per question 2 below) since one of my cases is closed, they will start the 3rd one now. Q.2-  Yesterday in Sharia Court, the Judge gave the judgment and gave me a fine of AED 3000/= and police case finished. Now 2 questions. a) Will the company file a civil case on me? b) If yes, then for how many months will they have to wait before they do it? Q.3- Now, my lease has also expired in July & the grace period of 1 month also ended by Aug 20, 2018. I received a letter from that company to renew the lease or they will file a case for eviction. What should I do here? Q.4- My other 2 CHKs hearing is due next week in Rahba Court, is it safe to ask the Judge to give a judgment? (I heard now on personal CHKs there is no Jail).

Last time, before 1 year, I was travelling to Kenya -Nairobi via Dubai and the immigration caught me saying I have to pay AED 6800 because Sharjah police station had a complaint about renting a car. So my friend paid the money in Sharjah at al Buhairah Police Station. After 2 hours, the immigration police released me and I went to Kenya. After 10 days I will come back to Pakistan via Dubai. Q: Greetings, I have a rental case opened against me due to failed rent payments and bounced cheques with the flat since August 2021 based on failed business. I had received a court order and a fixed amount to pay the amount in 5 installments. After that, I lost my job. And after contacting a typing center on my rental dispute case, I learned I have a travel ban and an arrest warrant. Even though I had the intention to pay, I had gone to the management with half the amount earlier before the enforcement case was opened and they refused negotiation. Until now, I haven't been able to secure a job because I can't get a cancellation from my previous company and I don't have better means to pay the initial amount requested for the first installment. Please, what can I do to at least get my name off the system to find a new job? And how much out of AED 35,000 must I fulfill to lift the ban or arrest warrant while I settle the balance instrumentally? Thanks.

In the UAE, cheque bounce is a very frequent problem faced by people during their span in the country. It is covered under the purview of Commercial Transactions Law, and legal implications/penalties can be financially severe and daunting for more “serious” offenses. Bounced cheque issues may arise in a variety of commercial transactions, including but not limited to, companies’ exchanges, bank loans, property rents or purchases, and individual transactions.

This Decree establishes a specialised judicial system to hear rent disputes and develops the procedure for determination of such disputes through an expeditious and simple process for the purpose of realising social and economic stability for all persons involved with the real property rental and other related sectors.

This Law promulgates the Federal Penal Code (Criminal Law) of the United Arab Emirates. Crimes and chastisement punishments shall be determined in accordance with the provisions of this Law and other penal codes.

The provisions of this Decree by Law amend the Federal Law No. (18) of 1993 by replacing Clause (4) of Article (379) as well as Articles (600), (617), (641), (642), (643), (644), and adding new articles numbered (635) Bis, (641) Bis (1), (641) Bis (2), (641) Bis (3), (641) Bis (4), (643) Bis (1), (643) Bis (2), (644) Bis (1) and (644) Bis (2). The Decree-Law also repeals Articles (401), (402) and (403) of the Federal Law No. (3) of 1987.

The provisions of this Federal Decree-Law No. (31) of 2021 Promulgating the Crimes and Penalties Law, known as the "New UAE Penal Code", governs criminal actions in the United Arab Emirates. The New Penal Code repeals the previous UAE Penal Code (Federal Law No. (3) of 1987 Promulgating the Penal Code).
