How to find out the official date of joining work?

Good day, Rajasree.

Inshallah you're doing pretty well.

I have a question, please.

When do they consider your official date of joining? Is it from the date you joined based on the contract between you and the employer or from when the visa was issued?

I have a case with a firm and they are claiming in their defence that my date of joining is when my visa was issued. To make it easier, I joined work on 24th June 2018 - Last day 7th July 2019.

The company is referring based on the labour contract (Limited), and it says that the contract is from the date I entered the country which is 26th July 2018, although I was here and I started work on 24th June 2018.

( I was terminated and the company is not claiming that).

Dear Questioner,

Thanks for writing to me.

Please note that the employer-employee relationship starts from the day you enter the UAE under the entry permit issued by the employer or on the day you signed the offer letter [MoL's offer letter].

Stamping of visa and issue of labour card...etc. takes place only after the initial stage of signing the offer letter.

From the above description, I understand that you entered the country under the work permit issued by the employer on 26th July 2018 and hence the same is considered as your joining date.

I am not sure under which visa you started working from 24th June 2018. Please note that it is illegal to work under a tourist visa.

Dear Rajasree,

Thank you for your swift response.

I've been living in the UAE forever (Never left the country).

My official joining date for the company was 24 June 2018 (First day at work). The offer Letter from the company mentioned and states that and signed by both parties.

The visa was issued later after joining. at the MOL offer, the contract was made on 17th July 2018 and it is mentioned that we agreed my contract date is from entering the country on 26th July 2018 - 25th July 2020.

My question is when is my actual official date of joining (How does the court look into that), so I can prove I've completed a year in order to be eligible to get all my compensation.

When did you sign the MoL offer letter?

The court will calculate on the basis on the said date.

Did I complete a year? When will the court calculate from?

If the MoL offer letter was signed on 24th June 2018, and if your last day of work is 7th July 2019 you have completed more than a year.

The court will approve which date once again.
