Calculating the last date of work as per the law and contract

Good Day Sir/Madam,

I want to ask you as my joining date in my company was 26 June 2015 but they pasted my visa on 9 August 2015.

I checked in “MOHRE” (a government application) that my end of the second contract will be 24 June 2019, but my friends told me it will be according to Emirates ID as 9 August 2019.

Please guide me what will be my last date of work. Will appreciate your reply.

Dear Aamir,

It is my pleasure to attend your inquiry.

The legal criteria to determine the beginning of employment relation shall be neither the visa date nor the date of issuance of your Emirates ID.

The court shall follow the contract as it's signed and entered between the related parties i.e. the employee and the employer and when such has been concluded.

Should there is no contract, then the actual first date of working is to be considered. Hence, you will be entitled to prove the 1st actual date of working either by a written contract or by other ways of evidence in accordance with the law articles.

As for the last working day, in order to enable me to provide proper advice, I need to know whether your employment contract is limited or unlimited.

The termination/end of the contract shall have major different consequences between the limited and unlimited contracts when we need to discuss the end of the relation.
