Q: Dear lawyer, I have a tenancy contract for one year in Dubai, ending on 25 November 2018. On the 8th of October, the landlord sent me a lease renewal, with some parts of the contract modified and contains different terms from the previous one. I decided I don't want to renew the contract; neither with the new nor old conditions. On the 1st of November, I notified the landlord that I will vacate on the current contract end date 25 Nov. He replied that I needed to notify him 90 days prior to the expiry date and I didn't, and now he is entitled to reimbursement and asks for 2 months' rent as a compensation. Our contract says only "Tenant agrees to notify the Landlord in writing 3 months (90 days) prior to the expiry of this Agreement of his intention to renew or not renew the Agreement". However, no financial penalties for breaking the clause of 90 days' notice of non-renewal are mentioned there. Please tell, can he claim from me this 2 months' amount? Q: Hi. I am a tenant and gave notice to my landlord on 3rd July 2017. The contract was for 12 months starting March 2017 but had the following provisions: "The Parties agree that there may be instances where the Tenant shall need to terminate the lease early, and in accordance with current guidelines the Tenant will give a two-month notice and two-month rent penalty in the case of immediate vacation." The landlord did not come to the pre-agreed date of vacating the premises on the 7th of September because I refused to pay him the two-month penalty, although I had already given him over 2 months notice. He is saying I have to pay him the additional 2 months even though I read it as only payable if I vacated immediately.

س: السلام عليكم، بصفتي مؤجرًا ألا يكفي أن أخطر المستأجر عن طريق الإيميل بعدم الرغبة في تجديد عقد الإيجار حسب المدة القانونية وهي 90 يومًا قبل انتهاء العقد في إمارة أبوظبي؟

س: السلام عليكم، لدي عقار بمنطقة الخليج التجاري بدبي مؤجَّر وعقد الإيجار ينتهي بعد 56 يومًا من اليوم. ليس لدي رغبة في تجديد العقد نظرًا لارتفاع الأسعار بحوالي 15 ألف درهم عن سعر الإيجار بالعام الماضي والزيادة القانونية للتجديد ستكون 10% فقط وهذا قليل جدًا نظرًا إلى أن العقد ينص على إرسال الإشعار قبلها بـ60 يومًا. كيف يمكنني إخطار المستأجر بعدم الرغبة في التجديد؟ وما الطريقة القانونية لذلك؟ وما المترتب على هذا؟ ولكم جزيل الشكر!

س: السلام عليكم، أنا مستأجر شقة في إمارة دبي واستلمت إيميل بتوقيع المالك قبل 90 يومًا من انتهاء العقد برغبة المالك في عدم التجديد. استلمت على الواتساب رسائل من المالك تسأل هل استلمت الاخطار. في ذلك الوقت كنت على علم أن مكان عملي سوف يتغير فلم أمانع الإخلاء ولم أقبله. بعد شهر، أرسل لي المالك إخطارًا جاهزًا للتوقيع مفاده أني طلبت عدم تجديد العقد. رفضت التوقيع ووضحت له أنني على استعداد لتجديد العقد وحاولت التواصل مع المالك لكن لم يستلم أي مكالمة من طرفي وتواصلت معه على الواتس بعدها بشهر ووضحت رغبتي في تجديد العقد. أجاب أنه لا يريد تجديد الإيجار وأننا على اتفاق علي عدم التجديد بالرغم من أنني لم اتفق على ذلك ولم أطلب عدم التجديد ولم أخبره بذلك. ما الوضع القانوني في هذه الحالة؟

س: السلام عليكم، يرفض المؤجِّر تجديد عقد الإيجار بنفس الشروط السابقة بالرغم من عدم إخطاري بتغيير أي بند من العقد قبل 3 أشهر، بل قبلها بشهر، ويريد مني الإمضاء على ورقة تجديد بتاريخ قديم على السعر الجديد. رفضت استلام الورقة لأنها غير قانونية والتاريخ غير صحيح. أريد الآن تجديد عقد الإيجار ورفعت دعوى عرض وإيداع ولكن لم يتم الرد من المؤجِّر ووافق القاضي على طلب العرض والإيداع وتم إغلاق الدعوى. ماذا أفعل الآن لتجديد العقد؟

س: السلام عليكم ورحمة الله وبركاته، يوجد مستأجر سُجن بسبب قضية وحاليًا تسكن الشقة زوجته وابنه وهي تدفع الأجرة بدون أي تأخير. انتهى العقد. هل يمكن تجديد عقد الإيجار تحت اسم الزوج وزوجته توقع مكانه؟ أم يجب ترك العقد بدون توقيع؟ أم يجب إبرام عقد إيجاري جديد باسم الزوجة وفي هذه الحالة يمكن تغيير الشروط والأحكام والقيمة الإيجارية؟ أرجو منكم الإجابة!

The relationship between tenants and landlords is regulated in Dubai by Law No. 33 of 2008 Concerning the Relationship Between Landlords and Tenants in the Emirate of Dubai. The arising rental disputes are referred to Rental Disputes Settlement Centre (“RDSC”) created by Decree No. 26 of 2013 to reconcile between the parties and reach an amicable settlement or seek a final judgment issued and enforced by the RDSC.

The provisions of this Law apply to real property leased out in the Emirate of Dubai, including vacant and agricultural lands, but excluding hotel establishments and real property provided by natural or legal persons as accommodation to their employees at no charge.

Provisions of this Law supersede articles (2), (3), (4), (9), (13), (14), (15), (25), (26), (29), and (36) of Law No. (26) of 2007 Regulating the Relationship between Landlords and Tenants in the Emirate of Dubai.
