What are the procedures to be followed before resignation?

Dear sir,

Requesting your legal advice.

I renewed my limited contract in June 2019. Now, I am starting the 3rd year. I got one month's leave salary and 30 days' leave home.

If I resign now from my contract:

1. What are the procedures I should follow before resigning?

2. What payments am I supposed to make to the company?

3. Am I entitled to any gratuity or benefits if I resigned from a limited contract?

Dear questioner,

Please find below my answers:

1- Submit a resignation letter and serve a notice period as per your contract.

2- Terminating a limited contract by the employee will result in paying early termination compensation that is equal to half of 3 months salary.

You will also be facing an automatic ban from working for any other employer for a period of one year, as per article 128 of the Labour Law:

"Where a non-national worker leaves his work without a valid reason before the expiry of a contract for a limited period, he may not, even with the employer's consent, take up other employment for one year from the date on which he left his work. It shall not be lawful for any other employer who is aware of the fact to recruit such worker or keep him in his service before the expiry of such period."

3- If you resign, you will only be eligible for gratuity if you completed 5 or more years.
