Gratuity eligibility upon resigning before labor card and Emirates ID expiry?

Dear Sir/Madam,

I have been working in a Dubai-based company since March 29, 2022, and my labor card will expire on March 28, 2024, while my Emirates ID will expire on April 22, 2024.

If I resign, my last working day will be on March 19, 2024. Will I receive a gratuity?

My company is asking for money.

Dear client,

Yes, you are eligible to receive a gratuity equivalent to 21 days' salary. This amounts to 21 days' salary for each year based on the basic salary.

Best Regards,

Dear Questioner,

If you have not served the notice period, then you have to pay the notice period salary to the company as payment in lieu of notice.

You will receive your gratuity till the date of your last working day. It will be better if you serve your notice period so that you don't have any obligation to pay anything to the company.

Dear Client,

Thanks for your question! I hope you are doing well. I will assist you in this matter.

In the UAE, employees are entitled to gratuity if they complete at least one year of continuous service with the same employer.

Since your last working day is before your labor card and Emirates ID expire, and you've completed over two years of service, you should be eligible for gratuity according to UAE labor law.

Your company asking for money is not permissible, and if they withhold gratuity unlawfully, you may file a complaint with MOHRE.

Dear Questioner,

The gratuity has nothing to do with the above circumstance. You will be entitled to receive the gratuity till the last working day.

Only you have to serve the notice period according to your contract. And you are leaving the job upon the contract expiry, so no need to pay any amount to the company.

You may leave the job after serving the notice period according to your employment contract.
