I resigned after over a year. Will I still receive any labor dues if a ban is imposed?

Dear Sir/Madam,

I ended up resigning from my company due to some issues in my country. I already knew that I would receive a ban.

Is there any chance that I will receive my last salary or any back pay?

I have been with the company for 1 year and 3 months.

You have to serve the notice period as per the UAE law.

Dear Questioner,

According to UAE labor law, if an employee resigns from their job, they are entitled to receive their last salary and any other benefits such as end-of-service gratuity, annual leave salary, and any other outstanding payments.

However, if the employee has a ban imposed on them, the employer may deduct any outstanding debts or expenses from the final salary.

In your case, since you have already resigned and have a ban imposed on you, it is best to discuss the matter with your employer and try to come to an agreement on the payment of your last salary and any other outstanding payments.

If your employer refuses to pay, you can file a complaint with the Ministry of Human Resources and Emiratization (MOHRE) to seek assistance in resolving the issue.

It is important to note that the length of your ban will depend on the reason for your resignation and the terms of your employment contract.

If you have completed more than one year of service with your employer, you may be eligible for a reduced ban period.

However, if you have violated the terms of your contract, the ban period may be longer.
