Q: I was working without a visa, and without insurance for 10 months.
My current employer knows from the beginning that I have problems with my previous company, as they didn't cancel my visa. Then I had troubles with overstay.
Our PRO first told me not to do anything, and then refused to help me. In the end, my employer said they will help me cancel everything and make a new visa for me, but it takes time.
I paid my fine in immigration and I paid in labour. Even when I get the visa, the insurance company is asking me also to pay because I had no insurance.
I should pay now for everything, and they even don't show a proof me for what. I was working with them, and they should provide me insurance and visa from the beginning.
They should have the quota and the PRO could help me from the beginning.
They are cutting my salary without informing me before, and not in small amounts. It is the third month now, and I have no proof of what.
What can I do?

Employer's liability in case of revoking an offer letter

Q: An offer letter was received from Abu Dhabi.
Last January, the security approval request was submitted by the company to the local government authorities to proceed with the employment visa application on my behalf.
Since then, there has been no feedback. Lately, the employer said they're not sure they can secure a visa for me.
What are my options? I assume the offer letter is legally binding, right?
I should note that it was extended to me to sign without prior signature and seal of the company. What's my standing?

Firstly, thank you for this service.
Let me briefly describe my situation.
Been in Dubai for a long time. Lost my job recently and frantically applying for a new one. Currently on garden leave until June, so only 2 more salary payments are pending.
I have a loan for AED 950k and an outstanding mortgage of 900k (the value of the property is 2m AED.
Afraid that after June I will not keep up with payments on the loan for sure which are 33k per month. Willing to settle since I have access to some funds but the bank only wants to settle on the full amount with all 5-year interest payments added.
I have access through the family of approx. AED 500k to use for settlement. The loan was for 5 years and paid without any defaults for 26 months. I have no savings at this time but in the coming June, I will most likely default.
Any advice would be appreciated.

Dubai employer fails to provide visa: can the employee file a complaint?

Q: Hello,
Is there a solution for an employee who signed a two-year contract with a company in Dubai and was promised that the company would provide an employment visa within 30 days?
However, the company failed to do so and did not even inform the employee. As a result, the employee's own visit visa expired, and the employee overstayed for two months and absconded.
The company even took the employee's passport.
The company has now been suspended for an unknown period of time, and the employee has not been paid since the suspension.
How can the employee file a complaint against the employer in this case?

How can I clear my overstay fines and come back to find a job in the UAE?

Q: Hello,
I would like to know the difference between overstay clearance and outpass. I am worried a company put me into overstay for 60 days but refused to give me an employment visa. All they told me is they're going to get me overstay clearance.
Understanding this situation, can I come back to the UAE and find another job or get a visit visa and look for a job again?

Q: Dear Lawyers,
My employer did not provide an employment visa. My visit visa status was changed to employment, and the expiry date was 27-10-2023.
I am still working, but my employer has not provided a residence visa, and I have not received my employer for six months.
What should I do? This is my first time working in the UAE.

Hello,
My employer fired me under Article 44 for not showing up for work for 7 days in a row. But that’s not the case at all. I was sick and the management was aware and they let me go.
I went to another country to get treatment because it’s expensive in Dubai. My employer did not pay me my salary for the month I worked and fired me.
I have official sick leave from another country and there is correspondence where my employer sent me to another country for treatment.
The problem is that the employer says that he will take compensation for the training that was specified in the contract, but I did not undergo training at all; I immediately started work from the first day of work and there was no training.
Does my employer have the right to charge me such a fee and not pay my salary?

How to cancel the MoU to buy an apartment with the broker if the bank did not approve the loan? 0
Hi,
I have a situation where I signed an MoU and gave my security deposit to the seller's agent. However later, the bank valuation of the property is lower than the selling price.
On my MoU, it has a clause that “the buyer has a right to cancel/negotiate if the bank valuation is not the same as MoU.” I tried to negotiate, however, we didn't agree on the price so I asked to cancel.
Now the agent is threatening me that they will not cancel the MoU and that will deposit my cheque. Later I also came to know that the person I am dealing with is not the same person whose name is mentioned as a broker in the MoU.
The agent I am dealing with is constantly messaging me with threats. I decided not to speak to him and instead, I wrote an email to the broker whose name is mentioned on the MoU but received no response.
I am on a very tight timeline as I need to vacate my apartment in 3 weeks, I found another unit but I don't know if I can pursue this while the initial MoU still not canceled.
Please, I need advice.
