س: رفعت زوجتي قضية طلاق للضرر ضدي وقت سفري للخارج وذلك بالضغط من أهلها، وقالت في لائحة الدعوى أنني هجرتها ولم أنفق عليها ولا على طفلي الاثنين وأنها استأجرت سكنًا خاصًا بعد أن تخليت عنهم، وهو لم يحدث جملة وتفصيلاً، وهناك ما يُثبت.
تركت لهم المصروف الخاص بالبيت وهناك رسائل واتساب تشهد بذلك قبل السفر.
ولكن لظروف مرض كورونا المنتشر حاليًا، لا يمكنني العودة بسبب إغلاق المطارات؛ ومع ذلك لا توجد مشكلة في إيجار السكن ولا المدارس وهناك مصروف لهم يكفي لمدة سنة.
هل إن رجعت وقدمت ما لدي من مستندات تفيد بأنني أخبرتها بسفري لرؤية الوالد، ولدي عقد إيجار للسكن صالح لآخر سنة ٢٠٢٠، وحتى رسوم المدارس تُخصَم من حسابي في البنك مباشرة، يرفض القاضي طلب الطلاق للضرر؟
لقد أعدت حجز الأبناء في المدارس عن طريق الإنترنت للسنة القادمة ٢٠٢٠/٢٠٢١، هل هذا يكفي لرفض طلبها؟
مع العلم أن الزوجة لم ترفق أي ورقة في الدعوى تُثبت إدعائها بأنها قامت باستئجار سكن. أنا أملك تلك المستندات باسمي وجميع الرسوم المدرسية والسكن وقد أبلغتها عن طريق الواتساب بغرض السفر.
مع العلم بأني مقيم في إمارة دبي.

Q: I got divorced in Dubai with mutual consent between me and my ex-wife in 2019.
My ex-wife has now engaged a lawyer and is seeking to file a new divorce in India, since as per her lawyer the divorce decree granted by the Dubai court is not valid and binding as we were married in Mumbai, India.
Hence the document doesn't seem to be a valid document and I am legally married to her according to her lawyer. Additionally, since I recently got married again here, they are claiming that a criminal case can be filed since bigamy is not permitted in India.
I was advised that a divorce by mutual consent from Dubai is valid and binding in India as well.
Please advise.

نفذت زوجتي الصيغة التنفيذية على حكم من 2007 بمبلغ نفقة 5000 شهريًا وتاريخ التنفيذ اليوم في 2021 ومكتوب في الحكم أنه حضوري ولم يخبروني عن هذا الحكم لأننا خرجنا من الجلسة وحلينا المشكلة في 2007 ورجعتها البيت والآن مطلوب تنفيذ الحكم الأسبوع القادم.

س: زوجتي ممتنعة عن الفراش لأكثر من سنتين، ومنذ أكثر من أربعة اشهر ترفض السكن معي تحت سقف واحد والآن تطلب أن أطلقها رغم أنني حاولت إصلاح الأمور ولكن دون جدوى.

Q: I would like to inquire about getting married in the UAE (regardless of which Emirate). There is one couple planning to get married this March 2023.
The groom is a Pakistani Muslim (divorcee) and the bride is Philipina Christian (legally married in the Philippines).
The bride is saying that she has not filed the annulment yet in the Philippines, which means that she is still legally married.
The bride is saying that there will be no Marriage Contract and the required documents are not yet needed. If they get married in Islamic law, is it legal?
Is there any legal consequence if they still continue getting married?

Q: Hello,
I am Christian and married to a Christian wife under Christian law in India (we are residents of the UAE). My wife has filed a case with the Personal Status Court for a travel ban to prevent my daughter from traveling with me.
The reasons given are:
- I have threatened to take the child to our home country and not return to the UAE, depriving the mother of her right to care for the child.
- I have forcibly taken the child’s passport from her.
Both points are false and defamatory. The judge, surprisingly, approved her request without consulting me. I have already responded legally, stating that these claims are false and requesting the case be dismissed, and I am awaiting the next step.
1. How can I file a case of libel to protect myself and my reputation?
2. Can I refuse any potential divorce proceedings in the UAE and continue such cases in India under Christian law?
3. Can I avoid any maintenance or alimony costs, as there are no valid grounds for divorce here?

Hello,
I hope you're all doing well during this tough time.
I have a question in regards to bounced cheques, specifically corporate cheques.
I have a cheque for AED 800,000, and it has bounced. The owner of the corporate has asked for a month to pay back. However, I am worried he will leave the country and not honour his obligation.
My questions are fairly simple:
1) Am I to put a case on the individual who signed it or the corporate?
1) If I put a criminal and civil case on the corporate right now and he's unable to settle amicably, can I put a travel ban on the owner (who signed) as it is a corporate case?
2) Does the new insolvency law as of late 2019 also apply to corporates?
3) Is the owner personally liable if the company doesn't have assets or cash?
