Cancellation of visa upon resignation and getting EOSB
Good evening Sir,
I am H., working as Asst. Manager under an unlimited contract, and now I completed 4 years and 10 months at this company.
I have resigned from the job effective 01.06.2019, and on a 30 days notice period. My boss instructed me to withdraw my resignation letter and give an apology letter, but I refused politely.
Last week, they accepted my resignation and they instructed me to vacate the accommodation. On 16.06.2019, I vacated my company accommodation and handed over all the things that belong to my company.
The facility of the motor car was revoked on May 30. My HR manager said (verbally) you can stop your duty, but he is not ready to send an official email.
Still, every day I am going to the office by taxi. Now, they are forcing me to sign the cancellation paper. I asked about my gratuity but the HR manager is saying you have to sign cancellation paper letter we will process your gratuity.
Sir, I am kindly requesting you to advise me on the procedure of how I can solve this issue in a professional way.

I understand that you have resigned on 1st June. 2019 and your notice period shall expire on 1st July 2019, however, you have been denied of your travel and stay.
Please tell me if you get a travel and accommodation allowance along with your salary? I don't think so but still would like to confirm with you.
Generally, companies in the UAE release EOSB after the cancellation of papers, however, this is merely a norm and not a rule.
You have two options with you, namely:
First, insist that you get your gratuity along with other entitlements before signing the cancellation papers as the cancellation papers mention that you have written all your dues.
The consequences if the company still does not release the gratuity is that the visa cancellation will not be processed.
You will have to file a labour complaint to claim your gratuity and compel the company to cancel the visa.
Second, sign the cancellation papers without receiving your dues and get your visa cancelled. If the company does not release the EOSB, then you will file a labour case to claim your gratuity and dues.
The benefit of this option is that your visa will be cancelled and you will be free to join another company in a proper work visa as opposed to a temporary work permit which the court issues.
