Possibility of leaving to home country while a labour case is running

Hi Sir,

My name is M. J., and I am working as an assistant accountant, in a construction company.

I already submitted my resignation letter one month before, because of my health problem. But the company is not responding to my resignation letter.

Here is my question, if I am going legally with the labour department, may I go back to my home country while the case is running?

(Still, I have the visa for more than 6 months).

Dear Mr J.,

Thank you for reaching out to me on this.

I understand your situation and you may file the labour complaint as soon as possible requesting the court to order the company to cancel your visa.

Considering that your visa is still valid, you may exit the country while the case is running.

However, you will need to appoint a representative or a lawyer via a power of attorney to appear on your behalf in the labour case.

I trust you will find this helpful.

Regards,

Hari Wadhwana
