Premature termination of tenancy contract and penalty

Our lease has an addendum that says we have a 2-month penalty for early termination. We are having a baby and will need to move to a bigger place.

We have asked to terminate our contract 4 months early and our management company said 'No'. Is it possible to just deny us the right to terminate our contract?

Dear Questioner,

The landlord cannot deny premature termination of the tenancy contract.

Most landlords settle for a one or two months’ worth of rent as a penalty, while some require up to three months in advance for breaking the contract prematurely.

In your situation as mentioned by you, 2 months rent as the penalty would be applicable.

However, in order to advise you precisely about the terms & conditions governing your contract, we would require to review the same. Accordingly, we can advise.

Hope the above satisfies your concern. For any query, you may contact us at a.odeh@miolawfirm.com or 0565989309.

Regards

Ahmed Odeh
