Questions & Answers
UAE inheritance: should succession for an expat start locally or abroad?
My brother-in-law (brother of my wife) has passed away in the UAE. He was the only sibling of my wife, and his mother passed away long ago. He had no children and left behind a widow and father. He had a property mortgaged and one off-plan property. He has a car lease and end-of-service pending with his company.
How and where should we start, and what is the best suitable approach? Should we start a succession certificate in the home country and then present it to the UAE court, or start in the UAE?
Dear Client,
Because the deceased owned assets and had financial obligations in the UAE, it is generally advisable to start by consulting a UAE inheritance lawyer and initiating the appropriate succession process in the UAE.
A succession certificate from the home country may be relevant, but it may not automatically be accepted in the UAE and could require legalization, attestation, Arabic translation, and recognition by the UAE courts.
You should first collect the death certificate, identification documents, marriage and family records, and all documents relating to the properties, mortgage, off-plan purchase, vehicle lease, and employment benefits.
The inheritance process should identify the legal heirs and also address the deceased’s outstanding debts and liabilities before the estate is distributed. Because the case involves several UAE assets and obligations, a lawyer should review the documents and advise on the correct procedure before you begin proceedings in either country.
We are honored to provide you with legal representation. To engage our services or for any inquiries, please get in touch with us. We look forward to assisting you.

Dear Questioner,
Thank you for contacting Al Fahad Legal Consulting.
With regard to the passing of your brother-in-law in the UAE, the handling of his estate, including the mortgaged property, off-plan property, vehicle lease, and pending end-of-service benefits, will generally require completion of the legal succession process before any assets can be transferred, claimed, or settled.
Under UAE law, the first step is usually to obtain the necessary succession documents identifying the legal heirs. Since the deceased passed away in the UAE and left assets within the UAE, the succession process may need to be addressed before the competent UAE courts. Depending on the applicable law, nationality, and personal status circumstances of the deceased and heirs, documents issued from the home country may also be required, legalized, and presented before the UAE authorities.
After the succession process is completed and the heirs are legally established, further procedures can be initiated with the relevant authorities, including the property developer, bank/mortgage provider, leasing company, and employer for the settlement of the deceased’s assets, liabilities, and end-of-service entitlements.
The appropriate approach depends on several factors, including:
- the deceased’s nationality,
- religion,
- country of residence,
- ownership details of the properties,
- mortgage status, and
- available family documents.
Therefore, we recommend reviewing the documents first to determine the most suitable succession route and avoid unnecessary delays.
If you require assistance, our legal team can guide you through the complete process, including reviewing the documents, coordinating the succession proceedings, and assisting with the required applications and communications with the relevant UAE entities.
Please feel free to share the available documents and details of the deceased, and we will advise you on the next steps.
Best regards,

Dear Client,
Thank you for reaching out, and please accept my condolences on the passing of your brother-in-law. I am Suhail Rana, Legal Consultant based in Dubai, UAE.
Your enquiry concerns succession and inheritance under UAE law. In general terms, when a person passes away in the UAE, their estate — including immovable property, off-plan units, vehicles, and any amounts owed to them such as end-of-service entitlements from their employer — together with their liabilities such as an outstanding mortgage and a car lease, is dealt with through the competent UAE courts. As a rule, the debts and secured obligations of the estate are settled first, and the remaining assets are then distributed among the lawful heirs (which in a case like this would ordinarily include the surviving widow and the father).
For non-Muslims, the distribution may be governed by Sharia principles, by a duly registered will, or by the law of the deceased's home country where applicable, so the precise shares and procedure depend on the deceased's nationality, religion, and whether a valid will exists. The heirs will normally need to obtain an inheritance/succession determination from the court before the assets can be transferred or sold and before claims against the employer or third parties can be pursued.
Because the outcome turns on these specific details and on the status of each asset and debt, I would need to review the documents to advise you and your wife precisely, and I would be glad to guide you through the full process.

An inheritance certificate must be prepared in his home country, specifying the heirs in detail and authenticated by the UAE embassy. The heirs should then gather and appoint a single person as their representative to receive the inheritance in the UAE.

Dear Client,
Thanks for your query. I am happy to assist you with your legal issue.
You should generally begin by opening an inheritance and estate file before the UAE court in the Emirate where the deceased lived or held the assets, because UAE court orders will be required to deal with the properties, mortgage, vehicle lease, and employment dues.
A home-country succession certificate may be obtained in parallel if required to establish the heirs or apply the deceased’s national law, but it must normally be legalised and translated into Arabic and may not, by itself, transfer UAE assets.
Collect the death certificate, passports and IDs of all potential heirs, marriage and family documents, title deed and off-plan contract, mortgage and lease statements, employment records, and details of any registered will; inheritance shares will depend on his religion, nationality, and applicable law.
Our team of legal professionals is available to open the UAE estate file, identify the lawful heirs, and coordinate recovery and transfer of all assets.
Thanks and Regards
Dear client,
Thank you for your detailed explanation, and please accept our sincere condolences for your family's loss.
Based on the information you have shared, the most appropriate approach is generally to initiate the inheritance and estate proceedings in the UAE, as the deceased's assets and liabilities are located here, including the mortgaged property, off-plan property, employment end-of-service benefits, and vehicle lease. The UAE Court can open the succession file, determine the legal heirs, and issue the necessary orders to deal with the estate in accordance with the applicable UAE laws and conflict-of-law rules.
Whether a succession certificate from your home country is required depends on several factors, including the deceased's nationality, religion, country of domicile, whether a valid will exists, and the jurisdiction where it was issued. In some cases, foreign inheritance documents may be recognized after legalization and attestation, while in other cases the UAE Court will require local succession procedures before the estate can be administered.
To provide accurate legal advice tailored to your case, we would be pleased to review the relevant documents, including the death certificate, passport/Emirates ID of the deceased, details of the assets, and information about the heirs. Following our review, we can arrange a free legal consultation (15–20 minutes) with one of our legal consultants to explain the appropriate legal procedure, expected timeline, and the most effective strategy for handling the estate in the UAE.
My name is Eslam Hegazy, Legal Consultant at Abdullah Al Otaibi Advocates & Legal Consultants, and I will be personally handling your matter and guiding you throughout each stage of the process.
I look forward to assisting you and helping your family complete the estate administration process in the UAE as smoothly and efficiently as possible.

Regarding the query, navigating the estate of a deceased expat in the UAE with complex assets like a mortgaged property, an off-plan purchase, a car lease and end-of-service benefits requires opening a formal succession proceeding rather than relying on a home country certificate, which involves lengthy attestation delays and jurisdictional hurdles.
Because the estate involves liabilities including active debts, mortgages and asset distribution among a surviving widow and father, handling these overlapping claims without legal coordination risks asset freeze complications or personal liability for debts.

Hello, hope all’s well.
Losing a family member is difficult enough without having to navigate inheritance, property, and financial matters across multiple jurisdictions. Since your brother-in-law owned assets in the UAE, including real estate, employment benefits, and vehicle finance, it's important to approach the estate administration correctly from the outset to avoid delays.
In most cases, where the deceased's assets are located in the UAE, the succession and estate procedures generally need to be addressed through the UAE courts, regardless of whether inheritance proceedings are also required in the home country. The appropriate process will depend on factors such as the deceased's nationality, religion, domicile, the location of the assets, and whether a will exists. The mortgaged property, off-plan property, end-of-service benefits, outstanding liabilities, and the rights of the legal heirs all need to be considered together before determining the correct legal strategy.
Please feel free to contact us. We can guide you through the UAE succession process, assist in obtaining the necessary court orders, coordinate the transfer of assets, liaise with the developer, bank, employer, and relevant authorities, and advise on whether any documentation from the home country will be required as part of the process.
