Q: I took a personal loan from a bank in Dubai, 130000 total. Now, my pending is 99300. I lost my job and now I got another job but salary much less, so some dues came. Now, the bank deposited my guarantee cheque and it bounced. They filed a case against me for cheating the bank. How can I solve this by paying a fine? I am not able to pay now monthly.

Q: Hi. I would like to ask a question. I had a bank loan in 2013, and due to crises, I lost my job in 2015 and couldn't continue my loan instalments. But now, I got a job in Dubai, and before coming to Dubai I spoke to the bank from my home country to remove police case and allow me to come to Dubai. The outstanding amount was AED 68K. The bank gave me a release letter with the help of Central Bank on the condition that I will continue my loan instalments, but my salary is not that big to be able to continue. So now the bank is telling me they will make a travel ban and civil case against me. My question is if bank files a case and I pay a fine in court against the cheque bounce, will the central bank or local bank still make another case or travel ban? Q: Good day! I have a loan and credit card with a bank in the UAE which I have defaulted on the payments for the last 8 months because I am unemployed, and currently in India. My security cheque amounted AED 35,000 was deposited and bounced, and now I have a police case and a ban on my name. I got a new job offer and my employer is not able to fix an employment visa for me because of this police case and ban. I tried to get a settlement deal with the NBFC, but it is not ending up with a good deal. So how can I overcome this issue to clear the police case? Is there any agency that can handle this on behalf of me to clear the police case and ban in court? Kindly advise

Q: I had taken a personal loan of AED 160,000 from the bank and I was paying regularly. Unfortunately, my boss took a huge loan and left the country, hence we have got stuck without salary and unable to cancel the visa. Finally, we found our local sponsor and cancelled the visa and got a new job with a lesser salary after 7 months. By that time, I became a defaulter and the bank bounced my cheque of AED 242,000 along with a police complaint. Now, what should I do? Do I get imprisonment? I am very scared.

Q: The bank has already filed a criminal case against my security check that they asked me to sign prior to taking the personal loan (after defaulting two EMI's payments, because I resigned from my job and currently still unemployed). My outstanding loan is AED 58,303. I have already paid them around AED 65K, and the amount they wrote on the check is AED 124K. Q: I am G. M. T. and I am holding a personal loan with a bank. My amount to be paid is nearly 50000 dirhams and my monthly EMI is 3060. I am facing irregularities in my salary and I manage somehow to pay my bank EMI on time by end of the month. Now this month (April 2022) EMI I failed to pay by the 5th and I am asking for time till Friday before the EID holidays but the bank is threatening me that they will file a case if I won’t pay it by today. Will I go to jail if the bank files a case against me for just one EMI pending? I am worried if my family has no one there to take care of them. We are struggling with daily expenses but still, I manage to pay my bank. Please advise what to do.

The management of individual financial affairs is crucial and all the actions must be weighed down while committing to any financial liability. Whether it's job loss that may have lead to financial failure or the opposite, one must be aware of the personal liability which will not diminish by paying fines for cheque bounce cases. There are two major types of liabilities, criminal liability and civil liability. Each has its own significance, hence, must be dealt with accordingly.

This Law promulgates the Federal Penal Code (Criminal Law) of the United Arab Emirates. Crimes and chastisement punishments shall be determined in accordance with the provisions of this Law and other penal codes.

This Law applies to merchants, as well as to all acts of commerce carried out in the UAE by any person even though he be not a trader. Commercial matters regarding which specific Federal laws are issued shall be subject to the provisions of such laws, and to the provisions hereof which do not contradict with said laws.

The provisions of this law, promulgating UAE Civil Code, govern the civil transactions in the United Arab Emirates. The commercial transactions remain subject to the laws and regulations applicable in their regard.

The provisions of this Decree by Law amend the Federal Law No. (18) of 1993 by replacing Clause (4) of Article (379) as well as Articles (600), (617), (641), (642), (643), (644), and adding new articles numbered (635) Bis, (641) Bis (1), (641) Bis (2), (641) Bis (3), (641) Bis (4), (643) Bis (1), (643) Bis (2), (644) Bis (1) and (644) Bis (2). The Decree-Law also repeals Articles (401), (402) and (403) of the Federal Law No. (3) of 1987.
