I refused the charge in court and the other party didn't come on 4 hearings so the court released me without any guaranty. س: مرحبًا بكم سعادة المستشارين، كان لدي سابقًا قضية تهديد مرفوعة من طليقتي بأنني هددتها عبر رسالة في تطبيق واتساب وعند سير القضية حُكم لي بالبراءة وطعنت النيابة على الحكم بالاستئناف ثم حصلت على براءة. إذًا فقد حصلت على براءة في التهمة المنسوبة لي. هل يحق لي رفع دعوى تعويض عن الضرر المعنوي والنفسي في المحكمة المدنية الجزئية؟ وكيف أثبت حقي في التعويض وأحصل عليه؟ علمًا بأن فتره التقادم 3 سنوات وأنا لم أتعدَ المدة المقررة؟

Q: Greetings, In 2018, I was wrongfully accused of assault. My colleague got into a fight with a local man outside of a restaurant. I never got involved but was somehow accused of assaulting this person. When I spoke to the prosecutor, I mentioned that there were several CCTV cameras that would prove that I never assaulted anybody but was told that "the CCTV cameras weren't working on that day". I was jailed for 20 Days, released on bail, and left the UAE without going to court in fear for my life. I recently requested my records which indicate an arrest warrant, 20,000 AED fine, 2 months in Jail, and a deportation order. I understand that the best way to have this settled is to file an appeal and appear before the judge. My biggest concern is what happens once I arrive in the UAE for the appeal. Will I be arrested and jailed again and potentially in a worse situation than before? I really would like to finally get this properly resolved so if anyone has any suggestions, I would love some advice. Thanks!

Q: I’m seeking a lawyer for a case of wrongful deportation in contravention of the UAE Constitution “Part Three: Freedom, Rights and Public Duties” Articles 25, 26, 27 & 28. The victim was a Dubai resident with Emirates ID & 2 years to expiry. One afternoon 3 police officers not in uniform broke down the front door of their apartment without proof of ID. Once inside, the officers ransacked the apartment without explanation. The 2 residents showed legal papers including Emirates ID, work permits, and apartment rental. Nothing was found & the resident was asked to accompany the officers to a bus with other females. At CID headquarters the victim was not given any explanation, was refused a lawyer & tried to contact their embassy. Under duress, they were taken to a private room, photos & eye scans were taken then forced to sign papers in Arabic without any translation. The victim was held for 2 weeks and then deported without explanation. How can they challenge this case & return to Dubai?

س: السلام عليكم، اشتكى شخص طبيبًا لدائرة الصحة مدعيًا وجود خطأ طبي حصل في علاج ابنه وذكر في شكواه أن ثلاثة مراكز طبية أقرت بوجود خطأ طبي. حققت دائرة الصحة وأرسلت لها المراكز الطبية الثلاثة أنه لا يوجد أي خطأ طبي وأن الطبيب المُشتكَى ضده عالج بمهنية عالية ولم يحدث منه أي خطأ وتقرير الصحة متوفر. بعد صدور التقرير وفوات مدة الاعتراض أو الاستئناف تمت معاتبة المشتكي فقال أنه رفع شكواه ضد المركز الطبي وليس الطبيب، ولكن اسم الطبيب هو الوحيد المذكور في التقرير والوحيد المُشتكى ضده. السؤال: هل يحق للطبيب مقاضاة المشتكي ومطالبته بالتعويض؟ وما المدة بعد صدور التقرير؟ نأمل في ردكم. وشكرًا!
