Applicability of the non-competition clause after leaving job

Dear Madam,

I was previously working as a manager in a company providing auditing & accounting services.

I had a non-compete clause inserted into my labour contract. Currently, I have joined a company with a similar practice at a lower salary and designation as I was not able to get a better opportunity.

I have informed my previous company regarding the same and they want an email from me stating that I won't indulge in direct competition. Will sending out such a letter have any implication in future?

Dear Questioner,

Thanks for contacting me online.

How long was that non-competition clause valid?

Even though you have joined another company, your current job profile will be different I hope.

Since you left the previous company, they have no right to ask for assurance in writing from you.

So it is better not to send an email according to their requirement.

Please feel free to contact me if you need further explanation or assistance.

Regards,

Anitha Rajeev

Thanks for the response, Madam.

My non-compete clause is for two years. There is a difference in my profile as compared to my previous company.

I was a manager in the previous company but had to come down from the managerial post for the current job.
