Q: Hi Sir
My company has filed a complaint against me in Police on the 5th of September but they stopped my duty on the 31st of May. They did not pay my salary from May to September.
Can I file a labour case and will let me sit free in a room till the court decision?
Please, advise if I can file a labour case.

Termination for redundancy and gratuity payment via PDC

Q: Dear Mr Hari,
I would like to ask your advice.
I have got a termination of my employment (unlimited contract) due to redundancy on September 2017 (a year ago).
Since my son is under my sponsorship & studying in a Dubai school, I have requested to not cancel the visa until it expires itself.
The company agreed to it due to the bad financial situation and inability to pay right away my "end of service" benefits.
Every 2-3 months they were paying some amounts of the annual leave & annual tickets.
My employment visa was cancelled completely in October 2018, and again due to bad financial situation the company was not able to pay the gratuity right away, so they provided the PDC.

Claiming passport from the employer after labour dispute

Q: Dear Respected Lawyers,
I am on management visa from Sharjah whose passport was denied by the employer after completing 13 months of service.
They told me passport can't be given until my client in Iraq settles a business transaction dues the company did. Feeling insulted, I resigned on June 20th 2018 and stopped going to the office waiting for my Iraqi client to visit the UAE.
Finally, the client came to Dubai on August 23rd and showed my employer his account where the client lost more than USD 700,000 because of the mismanagement of the project by the employer.
The employer left the meeting room saying I will never get my passport or visa cancelled. He told if ever I report it to the Labor Department, I will be put into trouble through his contacts with senior police officials.
Finally, I filed my labour complaint today for my Visa cancellation. Kindly advise whom should I approach at Sharjah Court to file a petition for getting back my Passport on an urgent basis.

الإخلال بشرط مدة الإنذار من قبل صاحب العمل

س: أنا طبيبة أسنان فُصلت من العمل.
رغب صاحب العمل في أن يدفع لي بدل شهر واحد لكن عقدنا ينص على مهلة 3 أشهر.
أخبرته أنني أرفض تعويض الشهر وأنني مستعدة للدوام لمدة 3 أشهر حسب العقد.
لا حاجة للعيادة لدوامي مع المرضى لأن الطبيب البديل موجود.
طلبوا مني الدوام 3 أشهر بمهام مكتبية حتى يجبروني على التخلي عن حقوقي، بحكم أن عقد العمل بيننا ينص على أن المُسمَّى الوظيفي لي "مساعد مدير".
هل يحق هذا لصاحب العمل؟
هذا مع العلم أنه توجد إثباتات أن طبيعة العمل لدي كانت أخصائية تقويم أسنان، وأن لدي رخصة من هيئة الصحة تدل على أنني مُرخَّصَة في هذه العيادة بالتحديد؟ أم أن الذي يحكمني هنا هو فقط عقد العمل والمسمَّى الوظيفي فيه؟

بعد التحية!
سؤالي بخصوص مدى إلزامية أن يسدد صاحب العمل مستحقات نهاية العمل للعامل عن طريق نظام حماية الأجور.
هل يجوز لصاحب العمل بدلاً من التحويل البنكي للمستحقات أن يسلم شيكًا بقيمتها أو أن يسددها نقدًا؟

المستحقات العمالية لدى تقديم الاستقالة بسبب تأخير الرواتب والخصم

س: السلام عليكم ورحمة الله وبركاته،
أعمل في شركة منذ 2013 وآخذ كل سنة من بداية عام 2013 لغاية شهر 6/2023 بدل سكن بـ4 شيكات سنويًا. في 2019 تم الاتفاق على بدل المدارس وكنت آخذه بشكل سنوي على 4 شيكات.
في شهر 7/2022 تم تخفيض راتبي من 12000 درهم إلى 10000 درهم. لم يُصرَف لي بدل مدارس عن الفترة 2022-2023. كان لي 7 رواتب متأخرة بقيمة 84000 درهم فقامت الشركة بالتسوية معي وإعطائي شيكات بقيمة 64000 درهم ووقعت على تنازل بعدم المطالبة بباقي المبلغ.
السؤال الآن:
أريد أن أقدم استقالتي من الشركة، فما الحقوق التي يمكن المطالبة بها؟

أعمل في جهة حكومية. أُنهيت خدماتي ولم أستلم مستحقاتي إلى الآن.
علمًا بأنني عملت لمدة 28 سنة.

إمكانية المطالبة بالمستحقات العمالية بناءً على الراتب الفعلي وليس المكتوب في العقد

س: السلام عليكم،
أعمل في شركة في العين مند ثلاث سنوات ونصف "منها سنة وعشرة أشهر إقامة تابعة للشركة" وما تبقى كنت أعمل بالإعارة من شركة أخرى. راتبي في عقد العمل 500 درهم ولكن راتبي الفعلي 2500 درهم.
هل يحق لي المطالبة قانونًا على حسب الراتب الفعلي؟
وهل فترة العمل بالإعارة تدخل ضمن أيام المستحقات؟
علمًا بأنني أستلم راتبي بشكل مباشر بإيصال قبض من الشركة، وراتب العقد (500) أستلمه بنكيًا أو عبر فروع الأنصاري.

Our internal contract has a notice period of 3 months from both parties. In the new labor implementation, only one month's notice is required for less than 5 years of service.
Please advise if we can follow our internal contract since the position is very curtailed and the organization will not be able to replace the position within one month.

Annual leave salary calculation as per the new labor law.
Can you please clarify the correct annual leave salary rules?
Some say it is basic + HRA for the month you will take off, others say it is full salary, and somewhere I read it is basic + HRA (annual leave salary) plus the normal salary you get.
Can you please clarify?

How to appeal the labor judgment if the court did not approve all my dues? 0
My employer has not paid my salary for 8.5 months. I went to the labor court, and was referred to Dubai Courts.
The judgment came and I did not receive the full claim including salaries and 3 months' compensation.
Please advise whether I can go for an appeal and what will be the time for execution.
