Q: Dear Sir/Madam, My property in Dubai was damaged due to floods and is now mostly uninhabitable. The property management/builder is not taking any steps to rectify the situation. Much of the damage occurred because a water pump in the nearby lake (part of the community) failed. If it had not failed, much less water would have entered the property. While I had a WhatsApp conversation confirming this, it was not mentioned in the contract because the agent claimed it was not a standard practice. However, I have now discovered that the chiller is connected to my DEWA. Q: The owner sent me an eviction letter a year ago and told me that he would not rent it again. I’ve asked multiple times if he was going to rent it and increase the price, but he said no. How to add a police report of physical assault to a family case after the judgment is issued?
Q: How to raise a request in the MOJ e-filing system (Smart justice portal) requesting the judge to obtain reports from the police and social support center? I`m a plaintiff (husband). On the 7th of Mar 2024, the first instance divorce judgment was provided based on Article 7 of Federal Law 41 of 2022 and Article 133 of the Code of Civil Procedures. The defendant (wife) was requested to pay expenses and fees. A verbal request was made to the judge during the trial by the plaintiff, but the court doesn`t have these records as per the court front desk. This report can prove a physical assault, infidelity, and written agreements made with social support and the defendant did abide by it, as the plaintiff was forced to initiate divorce. Is possible to raise it now after the judgment since it is an important record for future child custody? Or same request can be made again during the child custody case? Can I claim compensation from my husband for emotional and physical abuse?
Q: Good day everyone. We got married under Sharia Law in Dubai Courts and it is now 3 years with no kids. I have been suffering and enduring physical and verbal abuse throughout the marriage. But I just continued to stay in the hopes that my husband would change. I never thought of divorce because I was blinded by love and the concept of keeping our marriage sacred and with respect. Now, my husband has filed for divorce and his reason is our marriage will not work because of what he did last year (adultery). I felt so blank because I am jobless at the moment and can`t work as I am suffering emotionally and mentally. He will just leave me like this. My last resort is to be compensated for the damages I got, emotionally and physically. For proof, I have WhatsApp messages, a police report of the physical abuse (case closed), and a paper that shows a booking with his name and a woman when he traveled to a different country (to which I found out about the adultery). Q: Dear Sir/Madam, My landlord evicted me on the basis that he was selling the property. I have recently discovered that he did not sell and re-rented the property three months after I moved out, with a rental increase of AED 75,000 per year above what I was paying. It was very disruptive, and I was forced to move to a smaller property, incurring unnecessary costs as a result. This occurred approximately one year ago; however, I believe I have all the required evidence and supporting documentation. Q: Dear Sir/Madam, As the plaintiff, I filed a case in Dubai Courts through AL ADHEED regarding a bounced cheque. The court issued an order instructing the defendant to clear the payment by December 25, 2023. However, the defendant has not honored the judgment, and the payment remains unpaid.I received advice from the representative at AL ADHEED that my next step could be to request the blockage of their trade license. Will RDC accept a non-notarised eviction notice sent by registered post?
Q: Dear Sir/Madam, Eviction notice to the tenant due to sale: According to Article 25 (2) of Law No. (33) of 2008 Amending Law No. (26) of 2007 Regulating the Relationship between Landlords and Tenants in the Emirate of Dubai: "For the purposes of paragraph (2) of this Article, the Landlord must notify the Tenant of the eviction reasons twelve (12) months prior to the date set for eviction, provided that this notice is given through a Notary Public or registered post". The Law is clear that the notice can be sent by "registered post" as an alternative to being sent through Notary Public. I called DLD, they said the Notice must be sent by registered post after it is notarised. In case of a dispute, will RDC accept a non-notarised notice sent by registered post? أسئلة وأجوبة
