Evicted for claiming property sale, but re-rented. Can I seek compensation?
Dear Sir/Madam,
My landlord evicted me on the basis that he was selling the property. I have recently discovered that he did not sell and re-rented the property three months after I moved out, with a rental increase of AED 75,000 per year above what I was paying.
It was very disruptive, and I was forced to move to a smaller property, incurring unnecessary costs as a result. This occurred approximately one year ago; however, I believe I have all the required evidence and supporting documentation.
My question: Am I able to raise a case against my former landlord and seek compensation? If yes, what costs do I incur? If I am successful, how is the compensation calculated?
How long does a case like this normally take? If successful, is the landlord legally obliged to payout
Thank you!
Dear Questioner,
Yes, you can file a compensation case.
Costs: RDC fees are 3.5% of the amount of compensation you claim and a maximum of 15 thousand.
Compensation is usually the difference in the amount between the old rent and the new rent.
There is no specific time; maybe two, three, or four months, it depends on a lot of things.
If you win the lawsuit, the owner, of course, is obliged to pay.

Legal Counsel and Consultations
Thank you for reaching out with your concerning situation. I understand the frustration and inconvenience you have experienced due to the actions of your former landlord.
Based on the details you provided, it seems there might be grounds to pursue legal action.
In the United Arab Emirates, tenants have rights protected by law, and landlords must adhere to certain regulations, including providing accurate information regarding the reason for eviction.
If your landlord falsely claimed to be selling the property and subsequently re-rented it at a significantly higher rate, this could potentially be a breach of the law.
To address your specific questions, kindly consider the following:
- Legal Action and Compensation:
You may be able to raise a case against your former landlord seeking compensation for the disruptions and unnecessary costs incurred. The success of your case depends on the strength of the evidence you have gathered. I recommend a thorough review of your documentation to assess the viability of legal action.
- Costs:
The costs associated with pursuing a legal case can vary. I would be happy to discuss this with you further during a consultation where we can go over the specifics of your situation.
- Compensation Calculation:
If successful, the compensation amount is typically calculated based on various factors, including the financial losses you incurred, inconvenience, and any other relevant damages. This will be determined during the legal proceedings.
- Duration of the Case:
The timeline for such cases can vary. It depends on factors such as court availability, the complexity of the case, and the willingness of the parties to negotiate. I can provide a more accurate estimate after assessing the details of your case.
- Legal Obligation to Payout:
If successful, your former landlord may be legally obliged to compensate you as determined by the court.
To discuss your case in more detail and explore the best course of action, I encourage you to reach out to me via WhatsApp or phone. I am available to schedule a consultation at your earliest convenience.

Hi,
Hope you are doing great!
Referring to your enquire on re-renting the property by the landlord, we would like to inform you that you can claim for increased rent amount from the landlord through RDC.
Basically, such an increase in rent itself is the compensation and no further compensation will be allowed by the court.
The Court might take 2/3 months to conclude the same. In case you win, the landlord is obligated to refund your paid court fees too.
To exactly let you know how much you can claim, we need to see your tenancy contract and the contract with the new tenant if you have so.
Feel free to contact us via phone for more help and support.
