Q: Dear Sir/Madam, I would like to know if audio recordings are not allowed as evidence to upload on the Dubai Courts website. It`s because the system doesn`t allow me to do this. Most of my evidence consists of WhatsApp audio messages.

Signed MOU to buy property, but tenant refuses to leave. Can I cancel?
Q: Dear Sir/Madam, I have signed an MOU to buy a property. The MOU says that the property will be vacant on transfer. The current owner had given a 12-month notice to the tenant but the tenant is refusing to vacate. The owner has filed a case with RDC and the hearing date is also given. I worry that the tenant may not show up for the hearing and the hearing will be postponed beyond the MOU date. What are my options? Can I terminate the MOU and penalize the owner, or do I have to proceed with the property transfer regardless of the tenant leaving?2024/04/15

Is it mandatory to wait for 30 days from the date of judgment to implement a divorce judgment?
Q: I`m a plaintiff (husband). On the 7th of Mar 2024, the first instance divorce judgment was provided based on Article 7 of federal law 41 of 2022 and based on Article 133 of civil code proceedings. The defendant (wife) was requested to pay expenses and fees. Please advise me on the following questions: Is it mandatory to wait for 30 days from the date of judgment (the waiting period will end on the 7th of Apr 2024) to implement the ruling? What is the implementation of the ruling? Is it mandatory to raise this request? What are the documents or concerns that can be shared during the request to implement the ruling? Can the payment terms be changed from monthly to one upfront cheque?
Q: Hi there, My lease is up for renewal and I have agreed to the 10% increase, however, my landlord now wants to change payment terms from monthly payments which I have been doing for the past 3 years, into 1 cheque upfront which I can not afford or able to do. Does the landlord have a right to do this or can I refuse the terms but accept the increase of 10%? Your assistance is greatly appreciated.+1

New developer wants to change payment terms. How to me to protect my rights?
Q: Dear Sir/Madam, I bought a residential property for AED 7 million in Dubai from a developer in 2013 and registered the property in the same year. The project has been delayed and is still not complete. The original developer sold/transferred the project to another developer in 2022. The project is now 60% complete as per the latest RERA inspection report. The original payment terms in the Sales Purchase Agreement were a final balance payment of 40% to be payable on the handover of the property. However, now the new developer has drafted a new Sales Purchase Agreement where he is demanding 90% to be paid in stages while construction is in progress, and only a balance of 10% to be payable on the handover of the property. The RERA website states project completion by Dec 2025. Please advise if the new developer has the legal right to change these payment terms. What options are available to me to protect my investment and my rights?

Q: The case is that the parties did not agree on the governing law of the contract and the parties are residing in different countries. Also, the contract was concluded by each party in its country. How can a wife file a case for divorce and alimony if she does not live in the UAE?
Q: A wife filed a case for divorce 1 year ago. The court judgment rejected her divorce and alimony and to obey her husband. Not to leave home without permission. The same day she left home, her kids, and the country without permission. She canceled her visa. Soon I also left UAE. None is a resident of the UAE now and they have no visas. Now She filed an execution case for her alimony and again for divorce of harm also. We didn`t meet after 1st case. As she is not in the country. Never came back. How can I harm then? What should I do? I am also not living in the UAE. Children are with me. My question is, how can she open a case when both have not been living in the UAE for the last 1 year? How come I should pay her alimony when she never came back home and also left the UAE the same night after the court judgment? I don`t know where she is living. How and why do I pay her alimony when she left her home, kids, and country without info and permission? All again I need to prove that divorce for harm case. س: السلام عليكم، مقيم في الإمارات منذ ٣ أشهر فقط. صدرت ضدي أحكام في قضايا شيكات بإجمالي ٥ قضايا كلها غيابية ولم أقدم معارضة. علمًا بأن الأحكام في بلدى الأصلي. هل يمكن أن تسبب هذه القضايا أي ضرر لي هنا في العمل أو تتسبب في خروجي من البلاد؟
