How to respond to a legal notice from the ex-wife of my brother claiming money from us?

I am from outside the UAE and would like to ask some questions about a possible adversarial proceeding against a legal consultant and a private party in the UAE.

A legal counsel from Dubai sent us a legal notice for payment in the amount of 944,586 USD and a 3-day limit of payment for alleged moral damages to her client.

They notified me and another party, my brother who’s in the US. The client of this counsel is my brother’s ex-partner.

I would like to know the following points based on the tenor of legal notice:

1. Can legal counsels who are not involved in civil litigation give such notices?

2. Are legal counsels permitted to estimate the amount of moral damages without a valid court order?

3. What are the possible sanctions on malicious imputation of a crime and baseless accusation?

I have contacted a lawyer in the US but I am yet to be familiarized with UAE law so thank you so much!

I am very curious as to know how they came up with almost 100k USD even if it were OK for them to send such notice and I found that the 3-day limit they imposed is rather arbitrary.

Esp. on the subject of the email, they couched it in a language as though we OWED/have the duty to REFUND them the said amount.

Moreover, they cited civil law provisions which I believe are not binding internationally. (Please correct me on this).

They even threatened to have my brother’s US VISA canceled on top of all other malicious imputations in the said notice.

I do not think it’s ethical for a legal consultant to issue such a notice and if anything, it only projected an air of intimidation. It has caused me and my brother great distress.

Any legal consultant working with a law firm can send a legal notice on his client's behalf.

2- Are legal counsels permitted to estimate the amount of moral damages without a valid court order?

Yes.

3- What are the possible sanctions on malicious imputation of a crime and baseless accusation?

Sorry, I can not answer this question before reviewing the legal notice you received.

Please note that the legal notice is not binding for you or your brother but you can consider it just a warning for their next step.

Sometimes we (as lawyers) send these notices just to test the waters.

At the beginning, we are honored to respond to your inquiry.

The answer is in general to the three points:

- It is permissible for anyone who has an interest to notify the debtor and demand the amount of the appropriate compensation. The court, after experience, must rule, in its opinion, the amount of the appropriate compensatory compensation.

- Estimating the compensation is a discretionary authority for the trial court.

- As for the penalties, its ruling depends on Recording and describing the crime. We are dealing with a fraudulent crime if this is proven by documents. The documents must be viewed to explain your legal position.

There are several options in this kind of situation. First, it's a legal notice, but that doesn't mean you have to obey this, same as a court order.

We can send a reply to them in the same way and if they file a suit for the recovery of this amount, we can defend them with our grounds.

If they're only allegations, then the court will not entertain without evidence. we will discuss more. Kindly share your WhatsApp number to proceed with us.

1. Yes, a party to the matter can appoint legal counsel for representation and give them authorization to handle the matter.

2. No, they can send an estimate for payments in the legal notice but the same is not binding unless the judgment is passed by the Court.
