Can a landlord use the same evaluation certificate to increase the rent twice?
Q: Hello all, I`m renting a villa in the Springs area. Last year, the landlord made an evaluation certificate in March 2023 and 90 days before renewal, the property management company informed me that based on the evaluation certificate, the landlord would increase the price by 20%, I accepted it. Current contract from July 2023 till July 2024, rent value 160,000. In March 2024, I received an email from the landlord (92 days before renewal) that he wanted to increase rent again by 20% and attached the same certificate from March 2023 which has been used for the 2023 contract renewal. The certificate states that validity is 1 year. So when they sent an email with a notification, the certificate was still officially valid. Can the landlord use the evaluation certificate twice to increase property rent in 2023 and then in 2024? Why evaluation certificate is valid for 1 year if the market changes every month? How can I check that the certificate is not "fake"? Can the landlord use a certificate issued in March 2023 to increase the rent for the property, considering that the contract renewal date is in July 2024?

How can I get a refund after discovering that the goods are inauthentic?
Q: Dear Sir/Madam, We are a Dubai-based LLC that purchased merchandise from another Dubai-based LLC. The stock was delivered in Hong Kong for our Asia business. This transaction occurred between two Dubai firms and was out of scope. However, upon inspection, the goods were found to be inauthentic. We have given the supplier several weeks to provide evidence of their authenticity, but they have failed to do so. Tests conducted in China and Hong Kong have confirmed their inauthenticity. We are seeking a refund of €83,655 for the goods, as well as reimbursement for additional warehousing and shipping costs totaling approximately €15,000 since January. We possess all necessary evidence, including communications with the supplier wherein they confirmed the authenticity of the goods, as outlined in the contract terms and their invoice. Selling inauthentic goods is considered a criminal offense in some countries, and we cannot afford to be associated with such practices, resulting in significant losses for our business.

Is there a timeframe for a property maintenance claim after vacating the apartment?
Q: Upon vacating your apartment, can you sue your landlord for ongoing maintenance issues while you lived there? For 3 years I had ongoing maintenance issues which the building would not fix properly. Furthermore, they have now tried to deduct from my security deposit despite not fixing several issues that occurred in the past 3 years! Is there a timeframe for a maintenance claim? I would like to sue them for years of lack of maintenance which destroyed my experience while living there. Please advise. Thank you.

RERA index is updated 53 days before the renewal date. Is it applicable?
Q: Dear Sir/Madam, I am writing to seek your advice regarding a potential rent increase for my tenancy located in Free Zone Dubai. On February 5, my landlord informed me via WhatsApp about a possible rent increase. However, this notification came before the 90-day window. I responded by providing the landlord with the RERA Index information dated Feb-05-2024, which indicated no change in rental rates for similar properties at that time. On March 13, 2024, the RERA Index was apparently updated, reflecting an increase in rental rates. My landlord then sent another WhatsApp message on the same date, citing this update as a justification for raising the rent. As per RERA regulations, any notification regarding a rent increase should be delivered within the designated 90-day window before the lease renewal date. Since the landlord`s latest message falls outside this timeframe, with only 53 days remaining before the potential renewal, I am unsure whether I am obligated to accept the proposed rent increase. أسئلة وأجوبة

Can I rent a new flat in Sharjah if I have an unuresolved rental dispute previously?
Q: Hello, I`m just looking for information related to rent disputes. A year ago, I had a real estate dispute in Sharjah and I agreed to make payments in installments with the landlord. Due to my financial situation, I still have not cleared the outstanding amount. I`ve ended up living in a small partition, luckily I have found people who can share the cost If I want to lease a new flat in Sharjah. But I`m not sure if I can still rent a flat under my name while the previous rental dispute is not closed. Am I able to rent a new flat under my name? Your righteous advice is highly appreciated. Can I rent a unit if there was a tenancy contract that expired but is not canceled yet?
Q: Dangling Ejari, a red flag? I am interested in renting a unit, but after investigation, it turns out the current Ejari is expired but not canceled. If my understanding is correct, a tenant can not register Ejari if the previous one is not canceled, putting the new tenant in a sort of limbo. Is that correct? Q: Hi, We sent a renewal notice to our Dubai-based tenant 84 days before his contract renewal, with a 10% increase in rent. The tenant neither agreed nor disagreed with the proposed rent and replied on the day of renewal that he wouldn`t be paying the proposed rent.
